           DIGEST  :    This bill contains necessary technical changes 
          as a result of provisions adopted in budget trailer bill, 
          AB 97 (Assembly Budget Committee), Chapter 3, Statutes of 
          2011, related to adult day health care.

           Assembly Amendments  delete the prior version of the bill, 
          which contained intent language regarding the Budget Act of 
          2011, and implement the current language regarding adult 
          day health care, and technical changes related to the 
          adoption of the budget bill, AB 97.

           ANALYSIS  :    This bill:

          1. Delinks licensure from Medi-Cal certification for adult 
             day health care centers (ADHCs).  Current law requires 
             ADHCs to be certified as Medi-Cal providers as a 
             condition of licensure.  AB 97 eliminated adult day

             health care as a Medi-Cal optional benefit.  This bill 
             delinks certification and licensure. 

          2. Makes changes to requirements for ADHCs that choose to 
             also operate adult day programs.  Specifically, requires 
             that ADHCs submit a notice to the state if choosing to 
             add an adult day program within the adult day health 
             care facility.  Also, specifies that review and approval 
             of an application to provide a dual program shall not 
             require an on-site inspection by the state.  Maintains 
             current law that allows ADHCs that provide adult day 
             program services to operate under an ADHC license only. 

          3. Specifies that the maximum licensed capacity for an ADHC 
             shall be determined by the local fire authority and 
             shall include limits for ambulatory and nonambulatory 
             participants.
