SUBJECT : Adult day health care
SOURCE : Author
DIGEST : This bill contains a technical change to the
date of implementation of a Medi-Cal provision contained in
AB 97 (Assembly Budget Committee), Chapter 3, Statutes of
2011 (Budget trailer bill, March 2011).
Assembly Amendments delete the prior version of the bill
passed in the Senate regarding the Budget Act of 2011, and
insert language regarding adult day health care.
ANALYSIS :
Existing law:
1.Establishes the Medi-Cal program, administered by the
Department of Health Care Services, under which health
care services are provided to qualified, low-income
persons. The Medi-Cal program is, in part, governed and

funded by the federal Medicaid Program provisions.
2.Provides, to the extent permitted by federal law, that
adult day health care (ADHC) be excluded from coverage
under the Medi-Cal program on the first day of the first
calendar month following 90 days after the effective date
of the act that added that provision or on the first day
of the first calendar month following 60 days after the
date the Department of Health Care Services secures all
necessary federal approvals to implement that provision,
whichever is later.
This bill:
1.Delays, by two months, the implementation of the
elimination of ADHC as a Medi-Cal optional benefit.
Provides that ADHC will no longer be a benefit in the
Medi-Cal program and that the benefit will end on the
first day of the month that follows 60 days after the
state receives approval from the federal government to
end the benefit. The state received federal approval on
July 1, thereby ending the benefit on September 1, 2011.
This bill delays the date to November 1, 2011.
2.Adds an appropriation allowing this bill to take effect
immediately upon enactment.
