BILL SUMMARY: SB 207, an urgency measure, would appropriate
$557,729.29 from various funds to the Victim Compensation and
Government Claims Board (board) to pay 211 claims accepted by
the board.

STAFF COMMENTS: Pursuant to the committee's rules, the Suspense
File rule does not apply to the provisions of this bill as
claims are considered valid obligations of the state.
Additionally, claims may have time sensitivity.
The State Board of Control was established in 1945. It was
revised and renamed the California Victim Compensation and
Government Claims Board by Chapter 1016/2000 (AB 2491, Jackson).
Government Code 13928 requires the board to ensure that all
claims which have been approved by the board, and for which
there exists no legally available appropriation, are submitted
for legislative approval at least twice during each calendar
year.
General Funds This bill appropriates funding for 209 stale dated
warrants and two reimbursement claims. The re-issuance of
stale-dated warrants is the most prevalent claim approved by the
board. For stale-dated warrants, the Controller must confirm

that (1) the check was not cashed and has not been issued and
(2) more than three years have elapsed since the check was
issued and the monies have reverted to the General Fund. For
these warrants an appropriation is needed to reissue the
payment. This category also may include state treasury bonds
that have not been redeemed within ten years of their maturity
date (there are no such claims in this bill), but the majority
of warrants are checks.
Special Funds This bill appropriates $7,697.81from the State
Highway Account in the State Transportation Fund; $2,576.72 from
the Motor Vehicle Account in the State Transportation Fund;
$5,256.35 from the Health Care Deposit Fund.
There is one action and two claims of note:
(1) This bill specifies that no funds shall be expended for
payment of claim number G588066 ($73.36). This claim is for a
stale-dated warrant which was submitted to the board to be
reissued had already been replaced by a separate check issued by
the Department of Fish & Game. That payment was not noted until
after the board approved the claim. While the board is
obligated to report the claim to the Legislature, but the
Legislature isn't obligated to appropriate funds for it. The
Legislature took a similar action in Chapter 576/2010 (AB 1715,
Fuentes).
(2) This bill appropriates funds for two claims against the
California Department of Corrections and Rehabilitation (CDCR)
for county reimbursement of extradition expenses that were not
submitted within required timelines to CDCR. These claims were
approved by the board in 2006, but failed to be included in a
claims bill. Since that time, the Department of Finance
secured adoption of budget trailer bill language so that if
these expenses aren't submitted for direct reimbursement within
six months, the same as any other travel report, late expense
reports can no longer be submitted through the board's claims
process for reimbursement. However, these two claims were
approved before the statute changed and the Department of
Finance approved the funding source for these.
The proposed amendment corrects a code reference.
