   An act relating to tidelands and submerged lands.


	LEGISLATIVE COUNSEL'S DIGEST


   SB 385, as introduced, Gaines. Tidelands and submerged lands:
public trust doctrine: Lake Tahoe.
   Under existing law, the State Lands Commission has exclusive
jurisdiction over all ungranted tidelands and submerged lands owned
by the state. Existing law also provides that all jurisdiction and
authority remaining in the state as to granted tidelands and
submerged lands is vested in the commission. The commission is
required to exclusively administer and control these lands.
   This bill would state the intent of the Legislature to enact
legislation that would require the State Lands Commission to
establish the highest level of public trust tidelands and submerged
lands at Lake Tahoe to be 6,223 feet Lake Tahoe datum, the source
elevation of the Truckee River, Lake Tahoe's only outlet.
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  It is the intent of the Legislature to enact
legislation that would require the State Lands Commission to do both
of the following:
   (a) Establish the highest level of public trust tidelands and
submerged lands at Lake Tahoe to be 6,223 feet Lake Tahoe datum, the
source elevation of the Truckee River, Lake Tahoe's only outlet.
   (b) Provide that the boundary for public trust tidelands and
submerged lands at Lake Tahoe shall not be higher than the natural
high-water elevation, as described in subdivision (a).
