    An act to amend Section 475 of the Business and
Professions Code, relating to professions and vocations. 
 An act to amend Section 53411 of the Government Code, relating
to local agency finance.

   SB 911, as amended, De León.  Professions and vocations:
denial, suspension, and revocation of licenses.   Local
agency bonds: report.  
   Existing law sets forth provisions applicable to the denial,
suspension, and revocation of licenses for specified professions and
vocations.  
   This bill would make a nonsubstantive change to these provisions.
 
   Existing law requires the chief fiscal officer of a local agency
issuing bonds to file an annual report with the governing body of the
local agency with respect to the amount of funds collected and
expended generally, and the status of any project required or
authorized to be funded from the proceeds of the bonds.  
   This bill would additionally require the report to include a bond
fund transparency component, to include specified information for
each expenditure of bond proceeds. It would require this information
to also be posted on the agency's Internet Web site. 
   Vote: majority. Appropriation: no. Fiscal committee: no.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    It is the intent of the Legislature in
enacting this measure to provide greater transparency and
accountability in the bond financing process, so the public can
readily review how the proceeds of taxpayer-authorized bonds are
spent. 
   SEC. 2.    Section 53411 of the   Government
Code   is amended to read: 
   53411.  The chief fiscal officer of the issuing local agency shall
file a report with its governing body no later than January 1, 2002,
and at least once a year thereafter. The annual report shall contain
all of the following:
   (a) The amount of funds collected and expended.
   (b) The status of any project required or authorized to be funded
as identified in subdivision (a) of Section 53410. 
   (c) (1) A bond fund transparency component, including all of the
following information for each expenditure of bond proceeds: 

   (A) The name and principal location of each recipient of funds.
 
   (B) The amount of the expenditure.  
   (C) The type of transaction.  
   (D) The identity of the local agency or authorized entity making
the expenditure. 
   (E) The funding source for the expenditure.  
   (F) A brief description of any item or service purchased pursuant
to the expenditure.  
   (2) This information shall also be posted on the agency's Internet
Web site in a format accessible to the public.  
   (3) This subdivision shall not be construed to require the
disclosure of information deemed confidential or otherwise exempt
from disclosure under state or federal law.  
  SECTION 1.    Section 475 of the Business and
Professions Code is amended to read:
   475.  (a) Notwithstanding any other provisions of this code, the
provisions of this division shall govern the denial of licenses on
the grounds of:
   (1) Knowingly making a false statement of material fact, or
knowingly omitting to state a material fact, in an application for a
license.
   (2) Conviction of a crime.
   (3) Commission of any act involving dishonesty, fraud or deceit
with the intent to substantially benefit himself or another, or
substantially injure another.
   (4) Commission of any act that, if done by a licentiate of the
business or profession in question, would be grounds for suspension
or revocation of license.
   (b) Notwithstanding any other provisions of this code, the
provisions of this division shall govern the suspension and
revocation of licenses on grounds specified in paragraphs (1) and (2)
of subdivision (a).
   (c) A license shall not be denied, suspended, or revoked on the
grounds of a lack of good moral character or any similar ground
relating to an applicant's character, reputation, personality, or
habits.
