SUMMARY
This bill is one of two annual education omnibus bills to codify
existing practice, correct technical errors in statute, update
cross references and delete obsolete references related to
education issues that do not involve teacher credentialing.
Specifically, this bill:
1)Replaces the term "mental retardation" with "intellectual
disabilities" in several sections of code to conform to
amendments to the federal Individual with Disabilities
Education Act.
2)Eliminates or replaces references, where appropriate, to the
Secretary for Education in several sections of code. Governor
Brown eliminated the Office of the Secretary for Education in
the 2010 Budget Act.
FISCAL EFFECT
No fiscal impact to implement this measure.
COMMENTS
Purpose . This bill, sponsored by the State Department of
Education (SDE), is the annual education omnibus bill to correct
errors, resolve conflicts, delete obsolete references, and make
other non-controversial changes. By tradition, objection to a
provision from the SDE, Department of Finance, or any of the
four legislative caucuses prevents that provision from being
included in the bill. The provisions contained in this bill meet
the requirements set forth for an omnibus bill.
