Bill Summary: ACR 140 commemorates the 60th anniversary of the
Brown v. Board of Education decision and urges the California
Department of Education (CDE) to provide model instructional
materials related to the Brown v. Board of Education decision.
Fiscal Impact: $150,000 in cost pressure (General Fund) for the
CDE to create new model instructional materials that meet the
specifications of this resolution.
Proposed Law: This concurrent resolution commemorates the 60th
anniversary of the Brown v. Board of Education decision, and
makes numerous findings and declarations relative to the history
and significance of the landmark decision. This resolution also
urges the CDE to provide model instructional materials to
schools that encourage schools to observe the Brown v. Board of
Education decision with appropriate educational activities that
help students understand the importance of tolerance, humanity,
and equality of opportunity.
Staff Comments: This resolution will not result in direct
additional state costs, because it does not have the force of
law. It does, however, create significant cost pressure for the
CDE to develop new model instructional materials that "observe
the Brown v. Board of Education decision with appropriate
educational activities that help students understand the
importance of tolerance, humanity, and equality of opportunity."
The cost of developing model instructional materials can vary
significantly, depending on how extensive the curriculum is, and
the cost of accessing the appropriate subject matter expertise.
The CDE already has model curriculum on the Brown v. Board of
Education decision, which was designed to commemorate the 50th

anniversary of the decision. Costs to develop new instructional
materials which build on the existing materials would like cost
approximately $150,000 (General Fund).
Author's Amendments remove the "urging" of the CDE to develop
new model instructional materials that "observe the Brown v.
Board of Education decision with appropriate educational
activities that help students understand the importance of
tolerance, humanity, and equality of opportunity.
Committee Amendments add additional historical information
relative to California anti-segregation case law and Governor
Earl Warren.
