   An act to add Section  35013   47605.4 
to the Education Code, relating to school districts.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 622, as amended, Campos. School districts: charter school
petitions: Internet posting.
   Existing law authorizes one or more persons to circulate a
petition for the establishment of a charter school within a school
district, and authorizes the petitioners to submit the petition to
the governing board of the school district for review and approval,
as provided.
   This bill would require  a   the petitioners
to post on the proposed charter school's Internet Web site, if one is
maintained, a copy of the petition, as provided. The bill would also
require a  school district to post on its Internet Web site
 this   a copy of the  petition  and
would provide that the cost to the school district, to post on its
Internet Web site the petition, is to be borne by the petitioners
 . By requiring a new duty on a school district, this bill would
impose a state-mandated program. 
   The California Constitution requires the state to reimburse local
agencies and school districts for certain costs mandated by the
state. Statutory provisions establish procedures for making that
reimbursement.  
   This bill would provide that no reimbursement is required by this
act for a specified reason.

determines that the bill contains costs mandated by the state,
reimbursement for those costs shall be made pursuant to these
statutory provisions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section  35013   47605.4  is
added to the Education Code,  preceding Section 35020
  ,  to read:
    35013.   47605.4.    (a) If the
petitioners of a proposed charter school maintain an Internet Web
site for the proposed charter school, the petitioners shall post on
the proposed charter school's Internet Web site a copy of the
petition submitted to the school district pursuant to Section 47605
that contains all the information required in Section 47605, within
five days from the date of submission. 
    (b)     (1)    A school
district shall post on its Internet Web site  any 
 a  petition for the establishment of a charter school that
is submitted to the school district for approval pursuant to Section
47605. 
   (2) The cost to the school district to comply with paragraph (1)
shall be borne by the petitioners of the proposed charter school.
 
  SEC. 2.    If the Commission on State Mandates
determines that this act contains costs mandated by the state,
reimbursement to local agencies and school districts for those costs
shall be made pursuant to Part 7 (commencing with Section 17500) of
Division 4 of Title 2 of the Government Code. 
   SEC. 2.    No reimbursement is required by this act
pursuant to Section 6 of Article XIII B of the California
Constitution because a local agency or school district has the
authority to levy service charges, fees, or assessments sufficient to
pay for the program or level of service mandated by this act, within
the meaning of Section 17556 of the Government Code.
