   An act to  amend   add  Section 
127750 of   18944.18 to  the Health and Safety
Code, relating to  statewide health planning and development
  building standards  .

   AB 980, as amended, Pan.  Office of Statewide Health
Planning and Development.   Building standards. 

   Existing law requires the California Building Standards Commission
to codify all building standards of adopting agencies or state
agencies that propose the building standards and statutes defining
building standards into one California Building Standards Code.
Existing law requires the commission to publish, or cause to be
published, editions of the building standards code in its entirety
once every 3 years.  
   This bill would require the commission, in conjunction with the
Office of Statewide Health Planning and Development, to adopt
emergency regulations to repeal a specific portion of the 2013
Triennial Edition of the Building Standards Code, and would prohibit
the commission from adopting building code standards that establish
construction requirements for primary care clinics that provide
medication or aspiration abortion services that differ from
construction standards applicable to other specified primary care
clinics.  
   Existing law establishes the Office of Statewide Health Planning
and Development within the California Health and Human Services
Agency and requires the office to, among other things, develop a
Health Manpower Plan for California that consists of appropriate
standards for determining the adequacy of supply of specified health
personnel.  
   This bill would make a technical, nonsubstantive change to these
provisions.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 18944.18 is added to the 
 Health and Safety Code   , to read:  
   18944.18.  (a) It is the intent of the Legislature to preempt, and
to render inoperative, Section 1226.7 of the 2013 Triennial Edition
of the Building Standards Code.
   (b) The California Building Standards Commission, in conjunction
with the Office of Statewide Health Planning and Development, shall
adopt emergency regulations to delete Section 1226.7 of the 2013
Triennial Edition of the Building Standards Code, including all
cross-references to that section, as soon as possible.
   (c) Notwithstanding any other law, the Building Standards
Commission shall not adopt building code standards that establish
construction requirements for primary care clinics that provide
medication or aspiration abortion services that differ from
construction standards applicable to other primary care clinics
described in Section 1226.6 of the 2013 Triennial Edition of the
Building Standards Code.  
  SECTION 1.    Section 127750 of the Health and
Safety Code is amended to read:
   127750.  The office shall prepare a Health Manpower Plan for
California. The plan shall consist of at least the following
elements:
   (a) The establishment of appropriate standards for determining the
adequacy of supply in California of at least each of the following
categories of health personnel: physicians, midlevel medical
practitioners (physician's assistants and nurse practitioners);
nurses; dentists; midlevel dental practitioners (dental nurses and
dental hygienists); optometrists; optometry assistants; pharmacists;
and pharmacy technicians.
   (b) A determination of appropriate standards for the adequacy of
supply of the categories in subdivision (a) shall be made by taking
into account all of the following: current levels of demand for
health services in California; the capacity of each category of
personnel in subdivision (a) to provide health services; the extent
to which midlevel practitioners and assistants can substitute their
services for those of other personnel; the likely impact of the
implementation of a national health insurance program on the demand
for health services in California; professionally developed standards
for the adequacy of the supply of health personnel; and assumptions
concerning the future organization of health care services in
California.
   (c) A determination of the adequacy of the current and future
supply of health personnel by category in subdivision (a) taking into
account the sources of supply for personnel in California, the
magnitude of immigration of personnel to California, and the
likelihood of the immigration continuing.
   (d) A determination of the adequacy of the supply of specialties
within each category of health personnel in subdivision (a). The
determination shall be made, based upon standards of appropriate
supply to speciality developed, in accordance with subdivision (b).
   (e) Recommendations concerning changes in health manpower
policies, licensing statutes, and programs needed to meet the state's
need for health personnel.
