An act to amend Section 32282.1 of the Education Code, relating to school safety.

AB 1271, as amended, Bonta. School safety plans: pupil mental health care: violent acts.

Existing law provides that school districts and county offices of education are responsible for the overall development of a comprehensive school safety plan for each of their constituent schools. Existing law requires the schoolsite council of a school to write and develop the comprehensive school safety plan relevant to the needs and resources of the particular school. Existing law requires schools to forward copies of their comprehensive school safety plans to the school district or county office of education for approval. Existing law encourages comprehensive school safety plans, as they are reviewed and updated, to include clear guidelines for the roles and responsibilities of certain parties with school-related health and safety responsibilities and authorizes the inclusion in these plans of primary strategies for specified purposes.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

The people of the State of California do enact as follows:

SECTION 1.  

The Legislature finds and declares both of the
2following:

3(a) A paramount goal of the state is to ensure that all children
4receive a high quality education that enables them to reach their
5full potential and become responsible citizens who positively
6contribute to their communities and the state.

7(b) A safe and supportive learning environment is a necessary
8foundation for increasing academic achievement, enhancing healthy
9development, and improving educational outcomes for all children.

SEC. 2.  

Section 32282.1 of the Education Code is amended to
11read:

32282.1.  

(a) As comprehensive school safety plans are
13reviewed and updated, the Legislaturebegin delete requiresend deletebegin insert encouragesend insert all
14plans, to the extent that resources are available, to include clear
15guidelines for the roles and responsibilities of mental health
16professionals, community intervention professionals, school
P3    1counselors, school resource officers, and police officers on school
2campus, if the school district uses these people.

3(b) The guidelines developed pursuant to subdivision (a) shall
4include both of the following:

5(1) Primary strategies to create and maintain a positive school
6climate, promote school safety, and increase pupil achievement,
7and prioritize mental health and intervention services, restorative
8and transformative justice programs, and positive behavior
9interventions and support.

10(2) Protocols to address the mental health care of pupils who
11have witnessed a violent actbegin delete at school.end deletebegin insert defined in subdivision (a),
12(b), (e), (n), (o), (q), or (r) of Section 48900 occurring at any time,
13including, but not limited to, any of the following:end insert

SEC. 3.  

If the Commission on State Mandates determines that
20this act contains costs mandated by the state, reimbursement to
21local agencies and school districts for those costs shall be made
22pursuant to Part 7 (commencing with Section 17500) of Division
234 of Title 2 of the Government Code.
