SUBJECT : Solid waste recycling
SUMMARY : This bill includes technical clean-up language to
Chapter 476, Statues of 2011 (AB 341, Chesbro). Specifically,
this bill codifies the definition of "commercial solid waste"
rather than referencing a regulatory definition; corrects a
drafting error; and, corrects a cross-reference.
EXISTING LAW : Under to the Integrated Waste Management Act of
1989:
1)Requires the state to divert 75 percent of its solid waste
from landfill disposal annually by 2020.
2)Requires commercial generators of solid waste to arrange for
recycling services.
3)Requires local governments to implement commercial solid waste
recycling programs designed to divert solid waste from
businesses.
FISCAL EFFECT : Unknown
COMMENTS : This bill includes necessary technical and clean-up
language to new recycling program requirements enacted by AB 341
in 2011. Specifically, it codifies the definition of
"commercial solid waste" rather than referencing a regulatory
definition; corrects a drafting error that cited Section 426492,
rather than 42649.2; and, corrects a cross-reference to ensure
that the definition of commercial waste generator is
appropriately referenced.
