Existing law provides for the creation and regulation of cities, counties, and cities and counties. Existing law permits these agencies to form retirement and pension systems, and also permits these agencies to become contracting members of the Public Employees’ Retirement System. Existing law permits a city, a county, and other local governmental entities to provide compensation, including health care benefits, to its elected officials.
This bill would prohibit the legislative or governing body of a city, county, city and county, school board, special district, or any other entity of local government from granting lifetime healthcare benefits to an elected official whobegin delete serve part time.end deletebegin insert
serves part time, as specified. The bill would specify that these provisions do not prevent the award of, or continuation of, health care benefits that are entirely paid for by the individual.end insert

The people of the State of California do enact as follows:
Section 50034 is added to the Government Code,

(a) Notwithstanding any other law, the legislative body
4of a city, county, city and county, school board, special district,
5or any other entity of local government shall not grant lifetime
6healthcare benefits to an elected officialbegin delete who serves part timeend deletebegin insert on
7the basis of service as a part-end insertbegin inserttime elected officialend insert.
8(b) This section applies only to an individual who assumes a
9term of office commencing on or after January
1, 2015.
10(c) Nothing in this section shall prevent the award of, or
11continuation of, health care benefits that are entirely paid for by
12the individual.
