Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. The board of governors consists of 16 voting members, which includebegin insert 12 members, each appointed by the Governor with the advice and consent of end insertbegin insert2⁄3end insertbegin insert of the membership of the Senate to 6-year staggered terms,end insert one voting student memberbegin delete andend deletebegin insert,end insert

This bill wouldbegin insert require, commencing with the first specified vacancy after the operative date of the bill, the appointment of at least one voting member among the 12 discussed above who is a member or former member of the Armed Forces of the United States and who has demonstrated expertise and leadership in the field of veterans’ affairs. Section 71000 of the Education Code is amended

12(3) Commencing with the first vacancy after the operative date
13of the bill adding this paragraph that is not filled pursuant to
14paragraph (2), at least one of the 12 members shall be a member
15or former member of the Armed Forces of the United States, as
16defined in subdivision (e) of Section 66025.8, who has
17demonstrated expertise and leadership in the field of veterans’
18affairs.
19(b) (1) (A) (i) One voting student member and one nonvoting
20student member, who exercise their duties in accordance with the
21procedure set forth in paragraph (3).
22(ii) One voting student member who is a member or former
23member of the Armed Forces of the United States, as defined in
24subdivision (e) of Section 66025.8. For a voting student member
25appointed pursuant to this clause, all of the following apply:
26(I) For the purposes of subclauses (II), (III), and (IV), a
27
“member” means a voting student member appointed pursuant to
28this clause.
P3 1(II) A member may exercise the same privileges of a voting
2student member serving a second year term appointed pursuant to
3clause (i).
4(III) If a member resigns or the office is otherwise vacant, a
5voting student member who is a member or former member of the
6Armed Forces of the United States, as defined in subdivision (e)
7of Section 66025.8, and who meets the requirements of
8subparagraph (B) shall be appointed by the Governor pursuant to
9subparagraph (C).
10(IV) A member is exempt from paragraphs (2) and (4), and
11exempt from paragraph (3), except as provided by subclause (II).
12(B) A student member shall be enrolled in a community college
13with a minimum of five semester units, or its equivalent, at the
14time of the appointment and throughout the period of his or her
15term, or until a replacement has been named. A student member
16shall be enrolled in a community college at least one semester
17before his or her appointment, and shall meet and maintain the
18minimum standards of scholarship prescribed for community
19college students.
20(C) Each student member shall be appointed by the Governor
21from a list of names of at least three eligible persons submitted to
22the Governor by the student organization recognized by the board
23of governors.
24(2) The term of office of one student member of the board shall
25commence on July 1 of an even-numbered year, and
expire on
26June 30 two years thereafter. The term of office of the other student
27member of the board shall commence on July 1 of an
28odd-numbered year, and expire on June 30 two years thereafter.
29Notwithstanding paragraph (1), a student member who graduates
30from his or her college on or after January 1 of the second year of
31his or her term of office may serve the remainder of the term.
32(3) During the first year of a student member’s term, a student
33member shall be a member of the board and may attend all
34meetings of the board and its committees. At these meetings, a
35student member may fully participate in discussion and debate,
36but shall not vote. During the second year of a student member’s
37term, a student member may exercise the same right to attend
38meetings of the board, and its committees, and shall have the same
39right to vote as the
members appointed pursuant to subdivisions
40(a) and (c).
P4 1(4) Notwithstanding paragraph (3), if a student member resigns
2from office or a vacancy is otherwise created in that office during
3the second year of a student member’s term, the remaining student
4member shall immediately assume the office created by the vacancy
5and all of the participation privileges of the second-year student
6member, including the right to vote, for the remainder of that term
7of office.
8(c) Two voting tenured faculty members from a community
9college, who shall be appointed by the Governor for two-year
10terms. The Governor shall appoint each faculty member from a
11list of names of at least three eligible persons furnished by the
12Academic Senate of the California Community Colleges. Each
13seat
designated as a tenured faculty member seat shall be filled by
14a tenured faculty member from a community college pursuant to
15this section and Section 71003.
16(d) One voting classified employee, who shall be appointed by
17the Governor for a two-year term. The Governor shall appoint the
18classified employee member from a list of at least three eligible
19persons furnished by the exclusive representatives of classified
20employees of the California Community Colleges.
21(e) One voting member who is a member or former member of
22the Armed Forces of the United States, as defined in subdivision
23(e) of Section 66025.8, who has demonstrated expertise and
24leadership in the field of veterans’ affairs.
