AB 1557, as amended, Holden. Board of Governors of the California Community Colleges: student member.
Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. The board of governors consists of 16 voting members, which include 12 members, each appointed by the Governor with the advice and consent of 2⁄3 of the membership of the Senate to 6-year staggered terms, one voting student member, one nonvoting student member, and 2 tenured faculty members, as specified.
This bill would require, commencing with the first specified vacancy after the operative date of the bill, the appointment of at least one voting member among the 12 discussed above
who is a member or former member of the Armed Forces of the United States and who has demonstrated expertise and leadership in the field of veterans’ affairs. The bill would also add to the board of governors one voting student memberbegin delete whoend deletebegin insert and one nonvoting student member, each of whomend insert is a member or former member of the Armed Forces of the United States.

The people of the State of California do enact as follows:
Section 71000 of the Education Code is amended

There is in the state government a Board of Governors
4of the California Community Colleges, consisting of 17 voting

6(a) (1) Twelve members, each appointed by the Governor with
7the advice and consent of two-thirds of the membership of the
8Senate to six-year
staggered terms.
9(2) Two of the 12 members shall be current or former elected
10members of local community college district governing boards.
11(3) Commencing with the first vacancy after the operative date
12of the bill adding this paragraph that is not filled pursuant to
13paragraph (2), at least one of the 12 members shall be a member
14or former member of the Armed Forces of the United States, as
15defined in subdivision (e) of Section 66025.8, who has
16demonstrated expertise and leadership in the field of veterans’
17affairs.
18(b) (1) (A) (i) One voting student member and one nonvoting
19student member, who exercise their duties in accordance with the
20procedure
set forth in paragraph (3).

P3 1(I) For the purposes of subclauses (II), (III), and (IV), a

“member” means a voting student member appointed pursuant to
3this clause.
4(II) A member may exercise the same privileges of a voting
5student member serving a second year term appointed pursuant to
6clause (i).
7(III) If a member resigns or the office is otherwise vacant, a
8voting student member who is a member or former member of the
9Armed Forces of the United States, as defined in subdivision (e)
10of Section 66025.8, and who meets the requirements of
11subparagraph (B) shall be appointed by the Governor pursuant to
12subparagraph (C).
13(IV) A member is exempt from paragraphs (2) and (4), and
14exempt from paragraph (3), except as provided by subclause (II).
15(B) A student member shall be enrolled in a community college
16with a minimum of five semester units, or its equivalent, at the
17time of the appointment and throughout the period of his or her
18term, or until a replacement has been named. A student member
19shall be enrolled in a community college at least one semester
20before his or her appointment, and shall meet and maintain the
21minimum standards of scholarship prescribed for community
22college students.
23(C) Each student memberbegin insert pursuant to clause (i) of subparagraph
24(A)end insert shall be appointed by the Governor from a list of names of at
25least three eligible persons submitted to the Governor by the student
26organization recognized by the board of
governors.
27(2) Thebegin delete termend deletebegin insert termsend insert of office of one student member of the board
28begin insert pursuant to clause (i) of subparagraph (A) of paragraph (1), and
29one student member of the board pursuant to clause (ii) of
30subdivision (A) of paragraph (1)end insert shall commence on July 1 of an
31even-numbered year, and expire on June 30 two years thereafter.

33the board shall commence on July 1 of an odd-numbered year, and
34expire on June 30 two years thereafter. Notwithstanding paragraph
35(1), a student member who graduates from his or her college on
36or after January 1 of the second year of his or her term of office
37may serve the remainder of the term.
38(3) During the first year of a student member’s term, a student
39member shall be a member of the board and may attend all
40meetings of the board and its committees. At these meetings, a
P4 1student member may fully participate in discussion and debate,
2but shall not vote. During the second year of a student member’s
3term, a student member may exercise the same right to attend
4meetings of the board, and its committees, and shall have the same
5right to vote as the members appointed pursuant to subdivisions
6(a)
and (c).
7(4) Notwithstanding paragraph (3), if a student member resigns
8from office or a vacancy is otherwise created in that office during
9the second year of a student member’s term, the remaining student
10member shall immediately assume the office created by the vacancy
11and all of the participation privileges of the second-year student
12member, including the right to vote, for the remainder of that term
13of office.
14(c) Two voting tenured faculty members from a community
15college, who shall be appointed by the Governor for two-year
16terms. The Governor shall appoint each faculty member from a
17list of names of at least three eligible persons furnished by the
18Academic Senate of the California Community Colleges. Each
19seat designated as a tenured faculty member seat shall be filled by
20a
tenured faculty member from a community college pursuant to
21this section and Section 71003.
22(d) One voting classified employee, who shall be appointed by
23the Governor for a two-year term. The Governor shall appoint the
24classified employee member from a list of at least three eligible
25persons furnished by the exclusive representatives of classified
26employees of the California Community Colleges.
It is the intent of the Legislature that there be 16 voting
28members on the Board of Governors of the California Community
29Colleges until the first student member appointed to a position
30established by this act serves one year in office.
