This bill would require these agencies to directly obtain the price quotations from 2 or more certified small businesses, as specified.

The people of the State of California do enact as follows:
The Legislature finds and declares the following:

2(a) On February 18, 2014, the California State Auditor released
3a report finding that in the 2012-13 fiscal year, 83 percent of
4contract award amounts awarded to disabled veteran business
5enterprises (DVBEs) went to only 30 DVBE firms. This represents
6just 2 percent of the state’s DVBEs.
7(b) According to the California State Auditor, one DVBE firm
8entered into 922 contracts with six different awarding departments,
9while 81 percent
of DVBEs did not receive a single contract.
10(c) In this report, the California State Auditor makes the
11following recommendation to the Legislature: “For the DVBE
12program to benefit a broad base of disabled veteran-owned
13businesses financially, the Legislature should enact legislation
14aimed at increasing the number of DVBEs that contract with the
15State.” It is the intent of the Legislature to help implement this
16recommendation by encouraging agencies exercising the small
17business option to “cold call” small businesses and DVBEs that
18have not previously contracted with that agency.
19(d) Expanding the number of bids solicited from small businesses
20and DVBEs will increase competition and provide greater
21opportunities for participation in the program.
Section 14838.5 of the Government Code is amended
24to read:

26and protest provisions of Chapter 6 (commencing with Section
2714825) of this part and Chapter 2 (commencing with Section
2810290) and Chapter 3 (commencing with Section 12100) of Part
292 of Division 2 of the Public Contract Code, a state agency may
30award a contract for the acquisition of goods, services, or
31information technology that has an estimated value of greater than
32five thousand dollars ($5,000), but less than two hundred fifty
33thousand dollars ($250,000), to a certified small
business, including
34a microbusiness, or to a disabled veteran business enterprise, as
35long as the agency obtains price quotationsbegin delete directlyend delete from two or
36more certified small businesses, including microbusinesses, or
37begin delete directlyend delete from two or more disabledbegin delete veteransend deletebegin insert veteranend insert business
38enterprises.
P3 1(2) If the agency does not otherwise obtain more than two price
2quotations from either certified small businesses, including
3microbusinesses, or disabled veteran business enterprises, the
4agency
shall contact at least one additional certified small
5business, including a microbusiness, or at least one additional
6disabled veteran business enterprise, and provide a reasonable
7opportunity for the additionally contacted business or businesses
8to submit a price quotation. If the additionally contacted business
9or businesses decline to submit a price quotation, the agency may
10proceed with the two quotations it has obtained.
11(A) The agency may contact a business of a type described in
12this paragraph at any time and nothing in this paragraph shall be
13construed to delay the award of a contract by requiring that the
14agency first obtain the two price quotations required in paragraph
15(1) before initiating an additional contact with a business of a type
16described in this paragraph.
17(B) It is the intent of this subdivision to encourage an agency
18to award a contract to a business that has not previously contracted
19with the agency within the prior 12 months.
20(b) In carrying out subdivision (a), a state agency shall consider
21a responsive offer timely received from a responsible certified
22small business, including a microbusiness, or from a disabled
23veteran business enterprise.
24(c) If the estimated cost to the state is less than five thousand
25dollars ($5,000) for the acquisition of goods, services, or
26information technology, or a greater amount as administratively
27established by the director, a state agency shall obtain at least two
28price quotationsbegin delete directlyend delete
from responsible suppliers whenever there
29is reason to believe a response from a single source is not a fair
30and reasonable price.
Section 14838.64 of the Government Code is amended
32to read:
(a) Notwithstanding any other law, including, but
34not limited to, the advertising, bidding, and protest provisions of
35Chapter 6 (commencing with Section 14825) of this part and
36Chapter 2.5 (commencing with Section 10700) and Chapter 3
37(commencing with Section 12100) of Part 2 of Division 2 of the
38Public Contract Code, the California State University may award
39a contract for the acquisition of goods, services, or information
40technology that has an estimated value of greater than five thousand
P4 1dollars ($5,000), but less than two hundred fifty thousand dollars
2($250,000), to a certified small business, including a microbusiness,
3or to a disabled veteran business enterprise, if the California State
4University directly
obtains price quotations from two or more
5certified small businesses, including microbusinesses, or directly
6from two or more disabled veteran business enterprises.
7(b) In carrying out subdivision (a), the California State
8University shall consider a responsive offer timely received from
9a responsible certified small business, including a microbusiness,
10or from a disabled veteran business enterprise.
Section 10508.5 of the Public Contract Code is
12amended to read:
(a) Notwithstanding any other law, including, but
14not limited to, the advertising, bidding, and protest provisions of
15Chapter 2.1 (commencing with Section 10500), the University of
16California may award a contract for the acquisition of goods,
17services, or information technology that has an estimated value of
18greater than one hundred thousand dollars ($100,000), but less
19than two hundred fifty thousand dollars ($250,000), to a certified
20small business, including a microbusiness, or to a disabled veteran
21business enterprise, if the University of California directly obtains
22price quotations from two or more certified small businesses,
23including microbusinesses, or
directly from two or more disabled
24veteran business enterprises.
25(b) In carrying out subdivision (a), the University of California
26shall consider a responsive offer timely received from a responsible
27certified small business, including a microbusiness, or from a
28disabled veteran business enterprise.
29(c) No provision of this section shall apply to the University of
30California except to the extent that the Regents of the University
31of California, by appropriate resolution, make that provision
32applicable.
Section 20651.2 of the Public Contract Code is
34amended to read:
(a) Notwithstanding any other law, including, but
36not limited to, the advertising, bidding, and protest provisions of
37this article and Division 7 (commencing with Section 70900) of
38Title 3 of the Education Code, but subject to Section 88003.1, the
39governing board of a community college district may award a
40contract for the acquisition of goods, services, or information
P5 1technology that has an estimated value of greater than five thousand
2dollars ($5,000), but less than two hundred fifty thousand dollars
3($250,000), to a certified small business, including a microbusiness,
4or to a disabled veteran business enterprise, if the community
5college district directly obtains price quotations from two or more

certified small businesses, including microbusinesses, or directly
7from two or more disabled veteran business enterprises.
8(b) In carrying out subdivision (a), a community college district
9shall consider a responsive offer timely received from a responsible
10certified small business, including a microbusiness, or from a
11disabled veteran business enterprise.
12(c) The definitions set forth in Section 14837 of the Government
13Code apply to this section.
