                AB 1772 (Williams) - As Introduced:  February 14, 2014


           SUMMARY  :   Changes the membership on the advisory committee of  
          the California Law Enforcement Telecommunications System (CLETS)  
          by replacing the representative from the Department of General  
          Services (DGS) with a representative from the Office of  
          Emergency Services (OES).  

           EXISTING LAW  :

          1)Provides that the Department of Justice (DOJ) shall maintain a  
            statewide system of telecommunications for the use of law  
            enforcement agencies.  (Gov. Code � 15152.)

          2)Provides that the telecommunications system shall be under the  
            direction of the Attorney General (AG), and shall be used for  
            the official business of the state and the official business  
            of any city, county, or other public agency.  (Gov. Code, �  
            15153.)

          3)States that the AG shall appoint an advisory committee on  
            CLETS to advise and assist him or her in the management of the  
            system in respect to operating policies, service evaluation,  
            and system discipline.  The committee shall serve at the  
            pleasure of the AG without compensation, except for travel  
            expenses.  (Gov. Code, � 15154.)

          4)Provides that the advisory committee on the CLETS shall  
            consist of the following members:

             a)   Two representatives of the Peace Officers' Association  
               of the State of California;

             b)   One representative of the California State Sheriffs'  
               Association (CSAA);

             c)   One representative of the League of California Cities;

             d)   One representative of the California Supervisors  
               Association of California (CSAC);

             e)   One representative from the DOJ;

             f)   One representative from the Department of Motor Vehicles  
               (DMV);

             g)   One representative from the DGS;

             h)   One representative from the California Highway Patrol  
               (CHP); and, 

             i)   One representative from the California Police Chiefs'  
               Association.  (Gov. Code, � 15155.)

          5)Provides that the AG shall, upon advice of the Committee,  
            adopt and publish to the system subscribers and other  
            interested parties the operating policies, practices and  
            procedures, and conditions of qualification for membership.   
            (Gov. Code, � 15160.)

          6)States that CLETS shall provide service to any law enforcement  
            agency which at its own expense, desires connection through  
            the county terminal.  (Gov. Code, � 15613.)

          7)Provides that the DOJ shall maintain state summary criminal  
            history information pertaining to the identification and  
            criminal history of any person, such as name, date of birth,  
            physical description, fingerprints, photographs, date of  
            arrests, arresting agencies, booking numbers, charges,  
            dispositions, and similar data.  (Pen. Code, � 11105.)

          8)Provides that the AG shall furnish state summary criminal  
            history information to various authorized persons and  
            entities, including, among others, the courts of the state,  
            certain prosecutors, specified peace officers, probation and  
            parole officers, and a public defender or attorney of record  
            in certain situations.  (Pen. Code, � 11105.)

          9)Provides that the AG may furnish state summary criminal  
            history information to any peace officer of the state upon a  
            showing of compelling need provided that the information is  
            furnished to assist the officer in fulfilling employment,

            licensing, or certification duties.  (Pen. Code, � 11105,  
            subd. (c)(3).)

           FISCAL EFFECT  :   None

           COMMENTS  :   


           1)Author's Statement  :  According to the author, "Cal OES is  
            responsible for ensuring timely, efficient and accurate  
            communication between our emergency managers and first  
            responders-in many cases, making the difference between life  
            and death.  By updating their membership on the CLETS advisory  
            board, AB 1772 is an important step in ensuring that Cal OES  
            and our first responders are working together."


           2)Background  :  AB 1772 updates the named organizations that are  
            required to have a representative on the California Law  
            Enforcement Telecommunications System (CLETS) advisory  
            committee. This bill would eliminate the Department of General  
            Services (DGS) and would add the California Governor's Office  
            of Emergency Services (Cal OES), appropriately reflecting  
            current roles and responsibilities. 

            A representative from the Public Safety Communications Office  
            (PSCO) has historically served as a participating member of  
            the CLETS advisory committee. This position brings a wealth of  
            telecommunications knowledge and experience to the committee  
            due to the nature of PSCO's function within the state. Since  
            PSCO is the responsible entity for other public safety  
            communications systems, such as the state's 9-1-1 system, it  
            is important that it continues to play a role in other  
            important public safety telecommunications systems.

            Historically, since PSCO was part of DGS, a representative  
            from DGS was required to serve on the committee to ensure that  
            there was PSCO representation. However, as a part of the  
            Governor's 2012 reorganization plan, PSCO now serves under Cal  
            OES.  

            Cal OES is responsible for providing interoperable  
            communications between emergency managers, first responders,  
            and other disaster personnel. The California State Warning  
            Center, which is managed by Cal OES, serves as a backup

            communications tool that is used to notify law enforcement of  
            emergencies. The direct connection between CLETS, first  
            responders, and Cal OES highlights the key role Cal OES would  
            serve on the advisory committee.

            The requirement for a DGS representative to sit on CLETS  
            advisory committee doesn't reflect the changes in the 2012  
            governmental reorganization or the responsibilities of either  
            the PSCO or Cal OES. 

            AB 1772 simply updates the statute by changing the required  
            representative from DGS to Cal OES.
