   An act to  amend Section 69999.26 of the Education Code,
relating to postsecondary education   repeal and add
Section 25060 of the Government Code, relating to county gove 
 rnment  .

   AB 1862, as amended, Melendez.  Postsecondary education:
financial aid.  County board of supervisors: vacancy:
appointment.  
   Existing law requires the Governor to fill a vacancy on any county
board of supervisors.  
   This bill would, instead, authorize a quorum of a board of
supervisors, for 90 days after the date of the vacancy, to appoint an
individual to fill the vacancy, and, if the board does not, would
require the Governor to make the appointment.  
   Existing law establishes various student financial aid programs
under the administration of the Student Aid Commission, and
establishes eligibility requirements for the receipt of awards under
those programs by participating students attending qualifying
institutions. Existing law, until July 1, 2019, establishes the
California National Guard Education Assistance Award Program, which
provides financial aid to qualifying members of the California
National Guard, the State Military Reserve, and the Naval Militia,
under the administration of the commission. Existing law requires the
Legislative Analyst, on or before January 1, 2016, to prepare and
submit to the Legislature a report on the program.  

   This bill would instead require the Legislative Analyst to submit
that report to the Legislature on or before January 31, 2015.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 25060 of the  
Government Code   is repealed.  
   25060.  Whenever a vacancy occurs in a board of supervisors, the
Governor shall fill the vacancy. The appointee shall hold office
until the election and qualification of his or her successor.

   SEC. 2.    Section 25060 is added to the  
Government Code   , to read:  
   25060.  (a) (1) If a vacancy occurs on any board of supervisors, a
quorum of the board may, within 90 days after the date of the
vacancy, appoint an individual to fill the vacancy.
   (2) If a board of supervisors does not fill a vacancy pursuant to
paragraph (1), the Governor shall appoint an individual to fill the
vacancy.
   (b) An appointee shall hold the office until the election and
qualification of his or her successor pursuant to Section 25061.
 
  SECTION 1.    Section 69999.26 of the Education
Code is amended to read:
   69999.26.  The Legislative Analyst shall, on or before January 31,
2015, prepare and submit to the Legislature a report on the program
established in this article. The report may include recommendations
for modifying or extending this article.
