SUMMARY
This bill removes time limitations for Web site posting of
specified public disciplinary information about licensees of the
Medical Board of California (MBC), thereby requiring such
information to be posted on MBC's Web site for as long as that
information is public.
The information includes a revocation, suspension, probation, or
limitation on practice, as specified; a malpractice judgment or
arbitration award reported to MBC after January 1, 1993;
discipline from a board of another state or jurisdiction; and
any misdemeanor conviction that results in a disciplinary action
or an accusation that is not subsequently withdrawn or
dismissed.
FISCAL EFFECT
Minor and absorbable costs to MBC to retain and display data for
a longer time period.
COMMENTS
Purpose . This bill will require MBC to post indefinitely on its
website certain public data related to physician and surgeon
discipline, including suspensions and probation, malpractice
judgments, discipline from other states, and certain misdemeanor
convictions, that is currently taken down after ten years. This
bill is sponsored by MBC, which asserts the bill is needed to
increase transparency and allow consumers to access records
about physicians. The MBC's 2013 Sunset Review report
recommended this change.

Examples provided by MBC of lack of information that may be
misleading to consumers include doctors placed on probation for
sexual misconduct, sexual battery, and child molestation for
which information is not reflected on MBC's website due to the
current statutory time restrictions on posting information.
