SUMMARY
This bill creates an exception to the general prohibition on
possession, consumption, or sale of any alcoholic beverage on
the grounds of any public schoolhouse for certain special events
licensed or permitted by the Department of Alcoholic Beverage
Control (ABC) that are held at facilities owned and operated by
an educational agency, county office of education,
superintendent of schools, school district, or community college
district, so long as the event occurs at a time when pupils are
not on the facility grounds.

COMMENTS
1) Purpose. According to the author, this bill would permit
groups that rent out conference centers, office complexes, or
retreat facilities owned by an educational institution to
serve alcoholic beverages at their events when students are
not on the grounds. The author notes that under current law,
a county office of education, superintendent of schools,
school district, or community college district cannot rent
on-campus conference centers or office complexes for community
events (weddings, conferences, community service club
fundraisers, etc.) if alcoholic beverages will be served. As
a result, schools must forego extra revenue that could be
generated from allowing groups to rent out these facilities
when pupils are not on the grounds.

2) Background. Current law permits the possession, consumption,
and sale of alcoholic beverages at public schoolhouses in a
variety of other circumstances, including at nonprofit
fundraisers, at certain weekend events, as part of certain
community college culinary arts programs, at certain
performing arts events held by nonprofit organizations at
school-owned performing arts facilities, at certain community
center events if held at times when pupils are not present, at
certain collegiate sports events, and others.
