           DIGEST  :    This bill extends the time to file a notice of  
          extension for a Timber Harvest Plan (THP) from 30 days to 140  
          days prior to the expiration date.

           ANALYSIS  :    Existing law pursuant to the ZBerg-Nejedly Forest  
          Practice Act of 1973: 

          1.Prohibits any person from conducting timber operations unless  
            a THP has been prepared by a registered professional forester  
            and approved by the California Department of Forestry and Fire  
            Protection (CDF). Requires a THP to contain a description of  
            the location of the planned harvest, the harvest method,  
            measures to avoid excessive erosion, timeframe of operations,

            and other information required by forest practice rules  
            adopted by the Board of Forestry and Fire Protection. 

          2.Limits the effective period of a THP to five years.   
            Authorizes a THP to be extended for a two-year period in order  
            to complete timber operations if good cause is shown and all  
            timber operations are in conformance with the plan upon filing  
            of the notice of extension.  Requires a notice of extension to  
            be provided to CDF no sooner than 30 days, but at least 10  
            days, prior to the expiration of a THP.  Prohibits a notice of  
            extension from being approved if listed species have been  
            discovered in the logging area of the THP or significant  
            physical changes to the harvest area or adjacent area have  
            occurred since the THP's cumulative impacts were assessed. 

          This bill extends the time to file a notice of extension for a  
          THP from 30 days to 140 days prior to the expiration date.

           Background
           
          The Forest Practices Act prohibits timber operations unless a  
          THP has been prepared by a registered professional forester and  
          approved by CDF.  A THP must contain a description of the  
          location and method of the planned harvest, the timeframe of  
          operations, measures to avoid excessive erosion and any other  
          information required by regulations. 

          Generally, the effective period of a THP is limited to five  
          years.  A THP may be extended for a two-year period in order to  
          complete timber operations if good cause is shown and all timber  
          operations conform with the plan at the time of filing the  
          notice of extension.  An extension is prohibited if listed  
          species are discovered in the logging area of the THP or if  
          there are significant changes in the harvest area or adjacent  
          areas after cumulative impacts were evaluated.  THPs approved  
          between January 1, 2010, and December 31, 2011, may be extended  
          for two two-year extensions.

           ARGUMENTS IN SUPPORT  :    Supporters state that, "Extending the  
          life of a THP can allow a land manager more leeway to address  
          market and operational changes overtime and allow greater  
          opportunity for the integration of new adaptive management  
          techniques.  Better land management can occur when landowners  
          are not rushed to harvest areas and harvest when conditions are  
          optimal." [?]

          They continue, "Moreover, reviewing a THP extension permit calls  
          on the expertise of multiple agencies and can make the process  
          of reviewing and approving [?] THP extremely complex and  
          lengthy.  Allowing more time ensures that any concerns or  
          requests for changes be addressed."
