An act relating to state property, and making an appropriation therefor.

Existing law authorizes the Director of General Services to dispose of state surplus property, subject to specified conditions, including authorization by the Legislature. The California Constitution provides that the proceeds from the sale of surplus state property be used to pay the principal and interest on bonds issued pursuant to the Economic Recovery Bond Act until the principal and interest on those bonds are fully paid, after which these proceeds are required to be deposited into the Special Fund for Economic Uncertainties. Existing statutory law similarly requires that the net proceeds received from any real property disposition be paid into the Deficit Recovery Bond Retirement Sinking Fund Subaccount, a continuously appropriated fund, until the bonds issued pursuant to the act are retired.begin delete Existing law creates the Unemployment Compensation Disability Fund, which is continuously appropriated for the purpose of providing and administrating disability benefits.end delete

This bill would authorize the director to dispose of specified parcels of surplus state property. This bill would also specify the treatment of state and federal equity reimbursements in one of the properties being so disposed. By increasing the amounts transferred into continuously appropriated funds, this bill would make an appropriation.

The people of the State of California do enact as follows:

SECTION 1.  

(a) The Director of General Services may sell,
2exchange, sell combined with an exchange, or lease for fair market
3value, upon those terms and conditions as the Director of General
4Services determines are in the best interests of the state, all or any
5part of the following real property pursuant to Section 11011.1 of
6the Government Code:

7(1) Parcel 1, consisting of approximately 0.434 acres and
8improvements, known as the Employment Development
9Department parking lot located at 850 Turk Street in San Francisco,
10San Francisco County Assessor Parcel Number 0744-006.

11(2) Parcel 2, consisting of three parcels of approximately 0.29
12acres and improvements, known as the Employment Development

20(4) Parcel 4, consisting of approximately 1.1 acres and
21improvements, known as the Department of Public Health lab
22facility located at 1449 West Temple Street in Los Angeles, Los
23Angeles County Assessor Parcel Number 5160-005-900.

24(5) Parcel 5, consisting of approximately 2.03 acres and
25improvements, known as the Department of Corrections and
26Rehabilitation’s Fresno Female Offender Program Property, located

11(b) To the extent bonds issued by the State Public Works Board
12involve the property to be sold pursuant to this section, all issuer-
13and trustee-related costs associated with the review of any proposed
14sale, together with the costs related to the defeasance or retirement
15of any bonds, which may include the cost of nationally recognized
16bond counsel, shall be paid from the proceeds of any sale or lease
17authorized by this section.

18(c) Parcel 1 has both federal and statebegin delete equity and proceeds
19received from the disposition of Parcel 1 shall be treated as follows
