An act to amend Section 2191 of the Business and Professions Code, relating to physiciansbegin insert and surgeonsend insert.

Existing lawbegin insert, the Medical Practice Act, provides for the licensure and regulation of physicians and surgeons by the Medical Board of California. Existing lawend insert requires the Division of Licensing of the Medical Board of California to establish continuing education requirements for physicians and surgeons.

The people of the State of California do enact as follows:

SECTION 1.  

This act shall be known and may be cited as the
2Dolores H. Fox Act.

SEC. 2.  

Section 2191 of the Business and Professions Code is
4amended to read:

2191.  

(a) In determining its continuing education requirements,
2the Division of Licensing shall consider including a course in
3human sexuality as defined in Section 2090 and nutrition to be
4taken by those licensees whose practices may require knowledge
5in those areas.

6(b) The division shall consider including a course in child abuse
7detection and treatment to be taken by those licensees whose
8practices are of a nature that there is a likelihood of contact with
9abused or neglected children.

10(c) The division shall consider including a course in acupuncture
11to be taken by those licensees whose practices may require
12knowledge in the area of acupuncture and whose education has
13not included instruction in acupuncture.

14(d) The division shall encourage every physician and surgeon
15to take nutrition as part of his or her continuing education,
16particularly a physician and surgeon involved in primary care.

17(e) The division shall consider including a course in elder abuse
18detection and treatment to be taken by those licensees whose
19practices are of a nature that there is a likelihood of contact with
20abused or neglected persons 65 years of age and older.

21(f) In determining its continuing education requirements, the
22division shall consider including a course in the early detection
23and treatment of substance abusing pregnant women to be taken
24by those licensees whose practices are of a nature that there is a
25likelihood of contact with these women.

26(g) In determining its continuing education requirements, the
27division shall consider including a course in the special care needs
28of drug addicted infants to be taken by those licensees whose
29practices are of a nature that there is a likelihood of contact with
30these infants.

31(h) In determining its continuing education requirements, the
32division shall consider including a course providing training and
33guidelines on how to routinely screen for signs exhibited by abused
34women, particularly for physicians and surgeons in emergency,
35surgical, primary care, pediatric, prenatal, and mental health
36settings. In the event the division establishes a requirement for
37continuing education coursework in spousal or partner abuse
38detection or treatment, that requirement shall be met by each
39licensee within no more than four years from the date the
40requirement is imposed.

2division shall consider including a course in the special care needs
3of individuals and their families facing end-of-life issues, including,
4but not limited to, all of the following:

5(1) Pain and symptom management.

6(2) The psycho-social dynamics of death.

7(3) Dying and bereavement.

8(4) Hospice care.

10requirements, the division shall give its highest priority to
11considering a course on pain management.

12(k) In determining its continuing education requirements, the
