begin insert(1) Existing law establishes the K-12 High-Speed Network for the purpose of enriching pupil educational experiences and improving pupil academic performance by providing high-speed, high-bandwidth Internet connectivity to the public schools.

The bill would require the department to consider specified objectives in evaluating any proposed use of the funds, and would specify the purposes for which the funds may be allocated and used.

For purposes of assisting local educational agencies
4in providing schools with adequate Internet capacity to support
5new content standards, the California Assessment of Student
6Performance and Progress, and technology-based instruction for
7the purposes of improving the academic performance of pupils,
8there is hereby established the Broadband Infrastructure Fund.
(a) The Broadband Infrastructure Fund is established
10to achieve the following objectives:
11(1) To provide all local educational agencies with the minimum
12level of broadband connectivity to support the implementation of
13the common core academic content standards, Next Generation
14Science Standards, English language development standards, and
15the California Assessment of Student Performance and Progress.
16(2) To improve academic achievement through the integration
17of technology-based instruction in schools.
18(3) To ensure access for local educational agencies located in
19hard-to-serve areas of the state.
20(4) To encourage collaboration between local educational
21agencies, postsecondary educational institutions, and other cultural
22and educational research institutions for the purpose of leveraging
23regional resources.
24(5) To leverage existing statewide broadband infrastructure,
25such as the K-12 High-Speed Network and the California Research
26and Education Network, and other state, federal, and private
27funding sources.
28(6) To fund local educational agencies with planned last mile
29fiber or other projects to increase Internet capacity that lack
30requisite funding to complete installation.
31(7) To establish fiber-based broadband solutions that will allow
32local educational agencies to continue expanding Internet capacity
33with minimal investments in the future.
34(b) The department shall consider the objectives specified in
35this section when evaluating any proposed use of the funds.
The department shall allocate funds received pursuant
37to this chapter to any of the following:
38(a) Schoolsites that lack the minimum levels of broadband
39connectivity to support the implementation of the common core
40academic content standards, Next Generation Science Standards,
P4 1English language development standards, and the California
2Assessment of Student Performance and Progress.
3(b) Schools located in hard-to-serve areas or where competitive
4fiber-based broadband options are limited or not available.
5(c) Local educational agencies with planned last mile fiber or
6other projects to increase Internet capacity that lack requisite
7funding
to complete installation.
For purposes of this chapter, “local educational
9agency” means a school district, county office of education, charter
10school, or state special school.
This chapter shall not be implemented unless funding
12is provided for the Broadband Infrastructure Fund in the annual
13Budget Act or another statute.

16to Chapter 1 of Part 33 of Division 4 of Title 2 of the Education
17Code, to read:

This article shall be known, and may be cited, as the
23Innovation, Training, and Common Core Implementation Fund
24Act.
(a) For purposes of implementing the common core
26academic content standards adopted pursuant to Sections 60605.8,
2760605.85, as that section read on June 30, 2014,begin insert 60605.10,
2860605.11,end insert and 60811.3, as that section read on June 30, 2013, there
29is hereby established the Innovation, Training, and Common Core
30Implementation Fund. It is the intent of the Legislature that local
31educational agencies use funds allocated pursuant to subdivision
32(b) to support the integration of common core academic content
33begin insert standards, Next Generation Science Standards, and English
34language developmentend insert standards in
instruction for kindergarten
35and grades 1 to 12, inclusive, for purposes of establishing quality
36instructional programs for all pupils.
37(b) For the 2014-15 fiscal year, subject to subdivision (d), the
38Superintendent shall allocate funds to local educational agencies
39on the basis of an equal amount per pupil based on the prior year’s
P5 1enrollment. The allocated funds shall be available for encumbrance
2through the 2015-16 fiscal year.
3(c) A local educational agency shall expend funds allocated
4pursuant to this section for any of the following purposes:
5(1) Professional development for teachers, administrators, and
6paraprofessional educatorsbegin insert or other classified employees involved
7in the direct instruction of pupilsend insert

9(a).

15assessments.

26(d) As a condition of receiving funds allocated pursuant to this
27section, the governing board or body of the local educational
28agency shall do both of the following:
29(1) Develop and adopt a plan delineating how funds allocated
30pursuant to this section shall be spent. The plan shall be explained
31in a regularly scheduled public meeting of the governing board or
32body of the local educational agency before its adoption in a
33subsequent regularly scheduled public meeting.
34(2) On or before January 1, 2016, report detailed expenditure
35information to the
department, including, but not limited to, specific
36purchases made and the number of teachers, administrators, or
37paraprofessional educators that received professional development.
38The department shall determine the format for this report.
39(e) The department shall summarize the information reported
40pursuant to paragraph (2) of subdivision (d) and shall submit the
P6 1summary to the appropriate budget subcommittees and policy
2committees of the Legislature on or before July 3, 2016.
3(f) The requirement for submitting a report imposed under
4subdivision (e) is inoperative on January 1, 2019, pursuant to
5Section 10231.5 of the Government Code.
For purposes of this article, “local educational agency”
