Existing law requires a school district that elects to apply for certain state and federal categorical program funds to submit to the State Department of Education a single consolidated application, referencing a duly adopted single plan for pupil achievement, for approval by the State Board of Education. Related onsite school and district compliance visits and reviews are conducted by the department.

Existing law requires the Superintendent of Public Instruction to establish the process and frequency for conducting reviews of district achievement and compliance with state and federal categorical program requirements.

This bill would add to these provisions references to programs funded through the local control funding formula, districtwide advisory committees on bilingual education, and templates adopted for the development of local control and accountability plans. The bill would require school districts to develop local control and accountability plans and annual updates in consultation with schoolsite level advisory groups and ensure that the local control and accountability plan and its specific actions are consistent with, and reflective of, the goals and plans of the schoolsite.

Existing law requires a schoolsite council to be established at each school that participates in school-based program coordination. Existing law requires the governing board of a school district and the county superintendent of schools to each establish an English learner parent advisory committee if the enrollment of the school district, or the enrollment of the pupils in the schools and programs operated by the county superintendent of schools, includes a specified percentage and number of English learners.

This bill would state the intent of the Legislature to enact legislation that would update the role of schoolsite councils and English learner parent advisory committees so as to better align the operation of the councils and committees with the local control funding formula.

17(b) Onsite school and district compliance reviews of categorical
18programs shall continue, and school plans shall be required and
19reviewed as part of these onsite visits and compliance reviews.
20The Superintendent shall establish the process and frequency for
21conducting reviews of district achievement and compliance with
22state and federal categorical program requirements. In addition,
23the Superintendentbegin delete of Public Instructionend delete shall establish the content
24of these instruments, including any criteria for differentiating these
25reviews based on the achievement of pupils, as demonstrated by
26the Academic Performance Index developed pursuant to Section
2752052, and evidence of district compliance with state and federal
28law. The state board shall review the content of these instruments
29for consistency with state board policybegin insert and with the template
30adopted pursuant to Section 52064 for development of local control

33the department requires the plans in order to effectively administer
34any categorical program subject to this part. The department may
35require submission of the school plan for any school that is the
36specific subject of a complaint involving any categorical program
37or service subject to this part.

19(2) To facilitate the alignment of required activities and avoid
20the duplication of effort, as referenced in Sections 52063 and 52064
21with respect to school plans, local control and accountability plans,
22and federal law, a school district shall develop the local control
23and accountability plan and annual updates in consultation with
24schoolsite level advisory groups and ensure that the local control
25and accountability plan and its specific actions are consistent with,
26and reflective of, the goals and plans of the schoolsite.

27(e) Plans developed pursuant to subdivision (d) ofbegin insert formerend insert
28 Section 52054,begin insert as it read on June 30, 2013,end insert and Section 6314 and
29following of Title 20 of the United States Code, shall satisfybegin delete this

31(f) Notwithstanding any otherbegin delete provision ofend delete law, the content of

shall be aligned with school goals for improving pupil
34achievement. School goals shall be based upon an analysis of
35verifiable state data, including the Academic Performance Index
36developed pursuant to Section 52052 and the Englishbegin delete Language

begin insert language developmentend insert test developed pursuant to
38Section 60810, and may include any data voluntarily developed
39bybegin insert schoolend insert districts to measure pupil achievement. Thebegin delete Single Plan

P5    1a minimum, address how funds provided to the school through
2any of the sources identified in Section 64000 will be used to
3improve the academic performance of all pupils to the level of the
4performance goals, as established by the Academic Performance
5Index developed pursuant to Section 52052. The plan shall also
6identify the schools’ means of evaluating progress toward
7accomplishing those goals and how state and federal law governing
8these programs will be implemented.begin insert The plan shall also align
9with the school district’s goals for unduplicated pupils in the state
10and local priority areas identified pursuant to Section 52060.end insert

11(g) The plan required by this section shall be reviewed annually
12and updated, including proposed expenditure of funds allocated
13to the school through the consolidated application, by the schoolsite
14council, or, if the school does not have a schoolsite council, by
15schoolwide advisory groups or school support groups that conform
16to the requirements of Section 52852. The plans shall be reviewed
17and approved by the governing board of the localbegin delete educationend delete

19there are material changes that affect the academic programs for

21(h) The school plan and subsequent revisions shall be reviewed

SECTION 1.  

It is the intent of the Legislature to enact
33legislation that would update the role of schoolsite councils and
34English learner parent advisory committees so as to better align
35the operation of the councils and committees with the local control
36funding formula, including, but not limited to, aligning
37development of local control and accountability plans with school
38plans developed for state and federal programs pursuant to Section
3964001 of the Education Code.
