An act to amend Section 64001 of the Education Code, relating to school plans.

Existing law requires a school district that elects to apply for certain state and federal categorical program funds to submit to the State Department of Education a single consolidated application, referencing a duly adopted single plan for pupil achievement, for approval by the State Board of Education. SECTION 1.  

Section 64001 of the Education Code is amended
2to read:

64001.  

(a) (1) Notwithstanding any other law, a school district
4shall not be required to submit to the department, as part of the
5consolidated application, a school plan for categorical programs
6that are subject to this part. A school district shall ensure, in the
7consolidated application, that the single plan for pupil achievement
8established pursuant to subdivision (d) has been prepared in
9accordance with law, that schoolsite councils have developed and
10approved a plan, to be known as the single plan for pupil
11achievement, for schools participating in programs funded through
P3    1the consolidated application process and through the local control
2funding formula established pursuant to Section 42238.02, and
3any other school program they choose to include, and that school
4plans were developed with the review, certification, and advice of
5applicable school advisory committees, including advisory
6committees established pursuant to Section 52176. The single plan
7for pupil achievement may also be referred to as the single plan
8for student achievement. The consolidated application shall also
9include certifications by appropriate school district advisory
10committees, including advisory committees established pursuant
11to Section 52176, that the application was developed with the
12review and advice of those committees.

13(2) If a consolidated application does not include the necessary
14certifications or assurances, the department shall initiate an
15 investigation to determine whether the consolidated application
16and single plan for pupil achievement were developed in
17accordance with law and with the involvement of applicable
18advisory committees, including advisory committees established
19pursuant to Section 52176, and schoolsite councils.

20(b) Onsite school and district compliance reviews of categorical
21programs shall continue, and school plans shall be required and
22reviewed as part of these onsite visits and compliance reviews.
23The Superintendent shall establish the process and frequency for
24conducting reviews of school district achievement and compliance
25with state and federal categorical program requirements. In
26addition, the Superintendent shall establish the content of these
27instruments, including any criteria for differentiating these reviews
28based on the achievement of pupils, as demonstrated by the
29Academic Performance Index developed pursuant to Section 52052,
30and evidence of school district compliance with state and federal
31law. The state board shall review the content of these instruments
32for consistency with state board policy. If the department makes
33materials or information available to school districts to assist them
34in the development of their single plan for pupil achievement, the
35department shall ensure that all materials and information
36emphasize that the plan be consistent with and, to the extent
37possible, support the goals and outcomes specified in the school
38district’s local control and accountability plan, required pursuant
39to Section 52060.

P4    1(c) (1) A school district shall submit school plans whenever
2the department requires the plans in order to effectively administer
3any categorical program subject to this part. The department may
4require submission of the school plan for any school that is the
5specific subject of a complaint involving any categorical program
6or service subject to this part.

7(2) The department may require a school district to submit other
8data or information as may be necessary for the department to
9effectively administer any categorical program subject to this part.

10(d) (1) Notwithstanding any other law, as a condition of
11receiving funding for a categorical program pursuant to Section
1264000, and instead of the information submission requirements
13that were required by this section before January 1, 2002, a school
14district shall ensure that each school in its jurisdiction that operates
15 categorical programs subject to this part consolidates the plans
16that are required by those programs into a single plan. Schools
17may consolidate any plans that are required by federal programs
18subject to this part into this plan, unless otherwise prohibited by
19federal law. That plan shall be known as the single plan for pupil
20achievement or may be referred to as the single plan for student
21achievement.

22(2) To facilitate the alignment of required activities and avoid
23the duplication of effort, as referenced in Sections 52063 and 52064
24with respect to school plans, local control and accountability plans,
25and federal law, a school district shall develop the local control
26and accountability plan and annual updates in consultation with
27schoolsite level advisory groups and ensure that the local control
28and accountability plan and its specific actions are consistent with,
29and reflective of, the goals and plans of schoolsites.

30(e) Plans developed pursuant to subdivision (d) of former
31Section 52054, as it read on June 30, 2013, and Section 6314 and
32following of Title 20 of the United States Code shall satisfy the
33requirements of this section.

36for pupil achievement shall be aligned with school goals for
37improving pupil achievement. School goals shall be based upon
38an analysis of verifiable state data, including the Academic
39Performance Index developed pursuant to Section 52052 and the
40English language development test developed pursuant to Section
P5    160810, and may include any data voluntarily developed by school
2districts to measure pupil achievement. The single plan for pupil
3achievement shall, at a minimum, address howbegin delete fundsend deletebegin insert moneysend insert
4 provided to the school through any of the sources identified in
5Section 64000 will be used to improve the academic performance
6of all pupils to the level of the performance goals, as established
7by the Academic Performance Index developed pursuant to Section
852052. The plan shall also identify the schools’ means of evaluating
9progress toward accomplishing those goals and how state and
10federal law governing these programs will be implemented. The
11plan shall also align with the school district’s goals for unduplicated
12pupils in the state and local priority areas identified pursuant to
13Section 52060.

14(g) The plan required by this section shall be reviewed annually
15and updated, including proposed expenditure of funds allocated
16to the school through the consolidated application, by the schoolsite
17council, or, if the school does not have a schoolsite council, by
18schoolwide advisory groups or school support groups that conform

20and approved by the governing board of the local educational
21agency at a regularly scheduled meeting whenever there are
22material changes that affect the academic programs for pupils
23covered by programs identified in Section 64000.
