An act to amend Section 52074 of the Education Code, relating to school accountability.

AB 2408, as amended, Allen. School accountability: local control and accountability plans: California Collaborative for Educational Excellence.

Existing law, on or before July 1, 2014, requires the governing board of each school district and each county board of education to adopt a local control and accountability plan and requires the governing board of each school district and each county board of education to update its local control and accountability plan on or before July 1 of each year. Existing law requires the plan to include certain elements, and requires the charter for a charter school to include some of those same elements.

Existing law establishes the California Collaborative for Educational Excellence for purposes of advising and assisting school districts, county superintendents of schools, and charter schools in achieving the goals set forth in a local control and accountability plan. Existing law requires the collaborative to be governed by a board consisting of 5 members, as specified.

This bill would add a representative of charter schoolsbegin insert, appointed by the Senate Committee on Rules,end insert and a parent of a California public school pupil,begin delete each appointed by the Governor,end deletebegin insert appointed by the Speaker of the Assembly,end insert to the governing board of the collaborative.

The people of the State of California do enact as follows:

SECTION 1.  

Section 52074 of the Education Code is amended
2to read:

52074.  

(a) The California Collaborative for Educational
4Excellence is hereby established.

5(b) The purpose of the California Collaborative for Educational
6Excellence is to advise and assist school districts, county
7superintendents of schools, and charter schools in achieving the
8goals set forth in a local control and accountability plan adopted
9pursuant to this article.

10(c) The Superintendent shall, with the approval of the state
11board, contract with a local educational agency, or consortium of
12local educational agencies, to serve as the fiscal agent for the
13California Collaborative for Educational Excellence. The
14Superintendent shall apportion funds appropriated for the California
15Collaborative for Educational Excellence to the fiscal agent.

16(d) The California Collaborative for Educational Excellence
17shall be governed by a board consisting of the following seven
18members:

19(1) The Superintendent or his or her designee.

20(2) The president of the state board or his or her designee.

21(3) A county superintendent of schools appointed by the Senate
22Committee on Rules.

23(4) A teacher appointed by the Speaker of the Assembly.

24(5) A superintendent of a school district appointed by the
25 Governor.

26(6) A representative of charter schools, appointed by the

28(7) A parent of a California public school pupil appointed by
29thebegin delete Governor.end deletebegin insert Speaker of the Assembly.end insert

30(e) At the direction of the governing board of the California
31Collaborative for Educational Excellence, the fiscal agent shall
P3    1contract with individuals, local educational agencies, or
2organizations with the expertise, experience, and a record of
3success to carry out the purposes of this article. The areas of
4expertise, experience, and record of success shall include, but are
5not limited to, all of the following:

6(1) State priorities as described in subdivision (d) of Section
752060.

8(2) Improving the quality of teaching.

9(3) Improving the quality of school district and schoolsite
10leadership.

11(4) Successfully addressing the needs of special pupil
12populations, including, but not limited to, English learners, pupils
13eligible to receive a free or reduced-price meal, pupils in foster
14care, and individuals with exceptional needs.

15(f) The Superintendent may direct the California Collaborative
16for Educational Excellence to advise and assist a school district,
17county superintendent of schools, or charter school in any of the
18following circumstances:

19(1) If the governing board of a school district, county board of
20education, or governing body of a charter school requests the advice
21and assistance of the California Collaborative for Educational
22Excellence.

23(2) If the county superintendent of schools of the county in
24which the school district or charter school is located determines,
25following the provision of technical assistance pursuant to Section
2652071 or 47607.3, as applicable, that the advice and assistance of
27the California Collaborative for Educational Excellence is
28necessary to help the school district or charter school accomplish
29the goals described in the local control and accountability plan
30adopted pursuant to this article.

31(3) If the Superintendent determines that the advice and
32assistance of the California Collaborative for Educational
33Excellence is necessary to help the school district, county
34superintendent of schools, or charter school accomplish the goals
35set forth in the local control and accountability plan adopted
36pursuant to this article.
