Existing law authorizes the Director of Fish and Wildlife to enter into land use contracts to conserve waterfowl and waterfowl habitat with nonpublic entities that are owners of record, or with lessees, who have the owners of record execute the contract, of land determined by the director to be important for the conservation of waterfowl, subject to the appropriation of money for that purpose.
This bill would also authorize the director to enter into those contracts with public entities.

The people of the State of California do enact as follows:
Section 3460 of the Fish and Game Code is
2amended to read:
(a) Subject to appropriation pursuant to Section 3467,
4the director may enter into contracts withbegin insert public andend insert nonpublic
5entitiesbegin delete whichend deletebegin insert thatend insert are owners of record, or with lessees, who have
6the owners of record execute the contract, of land determined by
P2 1the director to be important for the conservation of waterfowl. The
2contract shall enforceably restrict the use of the land for the
3conservation of waterfowl and their habitatbegin insert,end insert
consistent with Section
48 of Article XIII of the California Constitution.
5(b) The director shall give priority to contracts that have the
6greatest potential for restoring, enhancing, and protecting high
7quality waterfowl habitat, especially thatbegin insert habitatend insert which is subject
8to destruction, drastic modification, or significant curtailment of
9habitat values.
10(c) Contracts entered into pursuant to this section are not subject
11to Part 2 (commencing with Section 10100) of Division 2 of the
12Public Contract Code.
