91215) of Subchapter 1 of Chapter 2 of Division 1 of Title 17 of
10the California Code of Regulations, as they exist on December 31,
112004, until the time when those regulations are revised pursuant

to Section 100703.
13(2) Laboratories that are accredited in forensic alcohol analysis
14by the American Society of Crime Laboratory Directors/Laboratory
15Accreditation Board or another accrediting agency approved by
16the review committee established pursuant to Section 100703 shall
P3 1be exempt from the requirements in Group 8 (commencing with
2Section 1215) of Subchapter 1 of Chapter 2 of Division 1 of Title
317 of the California Code of Regulations, as they exist on January
41, 2015, until the time when the department adopts regulations
5that incorporate the review committee’s revisions pursuant to
6Section 100703.
7(b) Notwithstanding subdivision (a), the department shall not
8require laboratories to be licensed.
Section 100703 of the Health and Safety Code is
11amended to read:
(a) On or before July 1, 2005, the department shall
13establish a review committee.
14(b) The review committee shall have eight members, including
15one person representing each of the following:
16(1) Prosecuting attorneys.
17(2) Law enforcement agencies.
18(3) Defense attorneys.
19(4) Coroners, pathologists, or medical examiners.
20(5) Criminalists.
21(6) Toxicologists.
22(7) Crime laboratory directors.
23(8) The State Department ofbegin delete Health Care Servicesend deletebegin insert Public Healthend insert.
24(c) The review committee shall meet at least once in each
25begin delete five-yearend deletebegin insert three-yearend insert period after its initial meeting, or within 60
26days of receipt of a request by the department or a member of the
27review committee.
28(d) The review committee shall evaluate Group 8 (commencing
29with Section 1215) of Subchapter 1 of Chapter 2 of Division 1 of
30Title 17 of the California Code of Regulations and determine
31revisions that will limit those regulations to those that the review
32committee determines are reasonably necessary to ensure the
33competence of the laboratories and employees to prepare, analyze,
34and report the results of the tests and comply with applicable laws.
