Existing law categorizes controlled substances into 5 schedules and imposes the greatest restrictions on those contained in Schedule I. Existing law, subject to exceptions, makes it an offense to, among other things, transport, import, sell, furnish, administer, or give away specified Schedule I and II controlled substances, or any Schedule III, IV, or V controlled substance which is a narcotic drug, unless upon written prescription, as specified.
This bill would make technical, nonsubstantive changes to these provisions.

The people of the State of California do enact as follows:
Section 11352 of the Health and Safety Code is
2amended to read:
(a) Except as otherwise provided in this division,begin delete everyend delete
4begin insert aend insert person who transports, imports into this state, sells, furnishes,
5administers, or gives away, or offers to transport, import into this
6state, sell, furnish, administer, or give away, or attempts to import
P2 1into this state or transport (1)begin delete anyend deletebegin insert aend insert controlled substance specified
2in subdivision (b), (c), or (e), or paragraph (1) of subdivision (f)
3of Section 11054, specified in paragraph (14), (15),
or (20) of
4subdivision (d) of Section 11054, or specified in subdivision (b)
5or (c) of Section 11055, or specified in subdivision (h) of Section
611056, or (2)begin delete anyend deletebegin insert aend insert controlled substance classified in Schedule III,
7IV, or Vbegin delete whichend deletebegin insert thatend insert is a narcotic drug, unless upon the written
8prescription of a physician, dentist, podiatrist, or veterinarian
9licensed to practice in this state, shall be punished by imprisonment
10pursuant to subdivision (h) of Section 1170 of the Penal Code for
11three, four, or five years.
12(b) Notwithstanding the penalty provisions of subdivision (a),

14 specified in subdivision (a) within this state from one county to
15another noncontiguous county shall be punished by imprisonment
16pursuant to subdivision (h) of Section 1170 of the Penal Code for
17three, six, or nine years.
18(c) For purposes of this section, “transports” means to transport
19for sale.
20(d) This section does not preclude or limit the prosecution of
21an individual for aiding and abetting the
commission of, or
22conspiring to commit,begin delete anyend deletebegin insert
anend insert act prohibited by this section.
