An act to add Part 1.7 (commencing with Section 16290) to
Division 4 of Title 2 of the Government Code, relating to
agriculture local government finance, and
making an appropriation therefor .

Existing law required, during the period on or after July 1, 2004,
but before July 1, 2011, the moneys in the Motor Vehicle License Fee
Account in the Transportation Tax Fund that remain unexpended at the
close of business on the last day of each calendar month to be
allocated by the Controller by the 10th day of the following month to
cities and counties, including an amount determined by a specified
formula to each city that was incorporated before August 5, 2004.
This bill would, beginning on January 10, 2015, and on the 10th of
each month thereafter, require the Controller to pay to each city
that incorporated before August 5, 2004, an amount equal to an amount
determined by that specified formula. This bill would continuously
appropriate to the Controller an amount sufficient to make those
payments from the General Fund.
Existing law provides for the direct marketing of agricultural
products, including through certified farmers' markets.
This bill would state the intent of the Legislature to enact
legislation relating to agritourism.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:
SECTION 1. Part 1.7 (commencing with Section
16290) is added to Division 4 of Title 2 of the Government
Code , to read:
PART 1.7. Payment of Funds for City Annexations
16290. (a) There is hereby continuously appropriated from the
General Fund to the Controller an amount sufficient to make the
payments required by this part.
(b) Beginning on January 10, 2015, and on the 10th of each month
thereafter, the Controller shall pay to each city that incorporated
before August 5, 2004, an amount equal to the product of the
following two amounts:
(1) The quotient derived from the following fraction:
(A) The numerator is the product of the following two amounts:
(i) Fifty dollars ($50) per year.
(ii) The fraction determined as the total amount of vehicle
license fee revenue collected during the most recent fiscal year
divided by the total amount of vehicle license fee revenue collected
during the 2004-05 fiscal year.
(B) The denominator is the fraction determined as the actual
population, as defined in subdivision (d) of Section 11005.3, of all
cities during the most recent fiscal year, divided by the actual
population, as defined in subdivision (d) of Section 11005.3, of all
cities in the 2004-05 fiscal year.
(2) The actual population, as defined in subdivision (d) of
Section 11005.3, residing in areas annexed after August 5, 2004, as
of the date of annexation.
(3) For purposes of this section, "vehicle license fee revenue"
means those amounts, less refund, collected pursuant to the Vehicle
License Fee Law (Part 5 (commencing with Section 10701) of Division 2
of the Revenue and Taxation Code).
SECTION 1. It is the intent of the Legislature
to enact legislation relating to agritourism.
