Existing law sets forth various provisions for the acquisition and maintenance of property by the state, and authorizes the Director of General Services to dispose of state surplus property by means of sale, lease, exchange, a sale combined with an exchange, or other manner of disposition of property, subject to specified conditions, including authorization by the Legislature.

This bill would begin delete declare the intent of the Legislature to enact legislation regarding the acquisition of real property by state agencies end delete begin insert authorize the Department of General Services to exchange, with the Canyon Vineyard Estates I, LLC, at fair market value and upon terms and conditions the director deems to be in the best interest of the state, certain surplus property under the jurisdiction of the Department of Transportation, as part of the land-for-land exchange for the Tuna Canyon Property end insert .

The Department of General Services may exchange,
with the Canyon Vineyard Estates I, LLC, at fair market value and
upon terms and conditions the director deems to be in the best
interest of the state, state surplus property under the jurisdiction
of the Department of Transportation, of equal or lesser value to
the property and funds being provided to the state, as part of the
land-for-land exchange for the Tuna Canyon Property.

The Legislature finds and declares that a special law
is necessary and that a general law cannot be made applicable
within the meaning of Section 16 of Article IV of the California
Constitution because of the unique circumstances applicable to
the land-for-land exchange for the Tuna Canyon Property.

It is the intent of the Legislature to enact
legislation regarding the acquisition of real property by state
agencies.
