Existing law, the Horse Racing Law, provides for the operation of live horse racing in this state and for wagering thereon, and for the operation of satellite wagering facilities, subject to regulation and oversight by the California Horse Racing Board. That law also requires the board to allocate racing weeks to an applicant, to specify racing days, dates, and hours for horse racing meetings as will be in the public interest, and provides that the decision of the board is subject to change, limitation, or restriction only by the board.

15(b) When the board receives a proposal from an applicant to
16make a substantial change to the number of racing dates allocated
17to a fair or racetrack, the board shall conduct an economic analysis
18of the proposal’s effect on other fairs and racetracks and shall
19consider all proposed alternative racing dates based on that
20economic analysis before the board votes on the proposal or any
21alternative option to the original proposal.
22(c) As used in this section, “substantial change” means any
23race date change that changes the dates more than three days from
24the prior year’s horse racing dates.
Section 40051 of the Public Resources Code is
26amended to read:
In implementing this division, the department and local
28agencies shall do both of the following:
29(a) Promote the following waste management practices in order
30of priority:
31(1) Source reduction.
P3 1(2) Recycling and composting.
2(3) Environmentally safe transformation and environmentally
3safe land disposal, at the discretion of the city or county.
4(b) Maximize the use of all feasible source reduction, recycling,
5and composting options in order to reduce the amount of solid
6waste that must be disposed of by transformation and land disposal.
7For wastes that cannot feasibly be reduced at their source, recycled,
8or composted, the local agency may use environmentally safe
9transformation or environmentally safe land disposal, or both of
10those practices.
