AB 2599, as introduced, Jones-Sawyer. Prisoners: organic therapies.
Existing law declares that all persons, including all persons involuntarily confined, have a fundamental right against enforced interference with their thought processes, states of mind, and patterns of mentation through the use of organic therapies and that this fundamental right requires that no person with the capacity for informed consent who refuses organic therapy shall be compelled to undergo such therapy.
This bill would make technical, nonsubstantive changes to these provisions.

The people of the State of California do enact as follows:
Section 2670 of the Penal Code is amended to
2read:
It is hereby recognized and declared that all persons,
4including all persons involuntarily confined, have a fundamental
5right against enforced interference with their thought processes,
6states of mind, and patterns of mentation through the use of organic
7therapies; that this fundamental right requires that no person with
P2 1the capacity for informed consent who refuses organic therapy
2shall be compelled to undergobegin delete suchend deletebegin insert thatend insert therapy; and thatbegin insert,end insert in order
3to justify the use of organic therapy upon a person who lacks the
4capacity for informed consent, other than
psychosurgery as referred
5to in subdivision (c) of Section 2670.5 which is not to be
6administered tobegin delete suchend deletebegin insert thoseend insert persons, the state shall establish that
7the organic therapy would be beneficial to the person, that there
8is a compelling interest in administeringbegin delete suchend deletebegin insert thatend insert therapy, and
9that there are no less onerous alternatives tobegin delete suchend deletebegin insert thatend insert therapy.
