An act to amend Section 79700 of, and to amend the heading of Division 26.7 (commencing with Section 79700) of, the Water Code, to amend Section 3 of Chapter 3 of the Seventh Extraordinary Session of the Statutes of 2009, to amend Section 9 of Chapter 126 of the Statutes of 2010, and to amend Section 2 of Chapter 226 of the Statutes of 2010, relating to the Safe, Clean, and Reliable Drinking Water Supply Act of 2012begin insert, and declaring the urgency thereof, to take effect immediatelyend insert.

Existing law creates the Safe, Clean, and Reliable Drinking Water Supply Act of 2012, which, if approved by the voters, would authorize the issuance of bonds in the amount of $11,140,000,000 pursuant to the State General Obligation Bond Law to finance a safe drinking water and water supply reliability program. Existing law provides for the submission of the bond act to the voters at the November 4, 2014, statewide general election.

This bill would change the name of the act to the Safe, Clean, and Reliable Drinking Water Supply Act of 2014 and declare the intent of the Legislature to amend the act for the purpose of reducing and potentially refocusing the $11,140,000,000 bond.

The people of the State of California do enact as follows:

SECTION 1.  

It is the intent of the Legislature to amend the
2Safe, Clean, and Reliable Drinking Water Supply Act of 2012 for
3the purpose of reducing and potentially refocusing the
4$11,140,000,000 bond.

SEC. 2.  

The heading of Division 26.7 (commencing with
6Section 79700) of the Water Code, as amended by Section 1 of
7Chapter 126 of the Statutes of 2010, is amended to read:

SEC. 3.  

Section 79700 of the Water Code, as amended by
13Section 2 of Chapter 126 of the Statutes of 2010, is amended to
14read:

79700.  

This division shall be known, and may be cited, as the
16Safe, Clean, and Reliable Drinking Water Supply Act of 2014.

SEC. 4.  

Section 3 of Chapter 3 of the Seventh Extraordinary
18Session of the Statutes of 2009, as amended by Section 2 of
19Chapter 74 of the Statutes of 2012, is amended to read:

Sec. 3.  

Section 1 of this act shall take effect only upon the
21approval by the voters of the Safe, Clean, and Reliable Drinking
22Water Supply Act of 2014, as set forth in that section at the
23November 4, 2014, statewide general election.

SEC. 5.  

Section 9 of Chapter 126 of the Statutes of 2010, as
25amended by Section 3 of Chapter 74 of the Statutes of 2012, is
26amended to read:

Sec. 9.  

(a) The Secretary of State shall submit Sections 79702,
2879716, 79749, and 79749.5 of the Water Code, as amended by
29Sections 2 to 6, inclusive, of this act, in place of Sections 79702,
3079716, 79749, and 79749.5 of the Water Code, as added by Section
311 of Chapter 3 of the Seventh Extraordinary Session of the Statutes
32of 2009, in order that they are voted upon as part of the Safe, Clean,
P3    1and Reliable Drinking Water Supply Act of 2014, at the November
24, 2014, statewide general election.

3(b) The Secretary of State shall submit the heading of Division
426.7 (commencing with Section 79700) of, and Section 79700 of,
5the Water Code, as amended by Sections 2 and 3 of this act, in
6place of the heading of Division 26.7 (commencing with Section
779700) of, and Section 79700 of, the Water Code, as amended by
8Sections 1 and 2 of Chapter 126 of the Statutes of 2010, in order
9that they are voted upon as part of the Safe, Clean, and Reliable
10Drinking Water Supply Act of 2014, at the November 4, 2014,
11statewide general election.

SEC. 6.  

Section 2 of Chapter 226 of the Statutes of 2010, as
13amended by Section 4 of Chapter 74 of the Statutes of 2012, is
14amended to read:

16the Water Code, as amended by Section 1 of this act, in place of
17Section 79770 of the Water Code, as added by Section 1 of Chapter
183 of the Seventh Extraordinary Session of the Statutes of 2009, in
19order that it is voted upon as part of the Safe, Clean, and Reliable
20Drinking Water Supply Act of 2014 at the November 4, 2014,
21statewide general election.

This act is an urgency statute necessary for the
23immediate preservation of the public peace, health, or safety within
24the meaning of Article IV of the Constitution and shall go into
25immediate effect. The facts constituting the necessity are:

26In order to ensure that the Safe, Clean, and Reliable Drinking
27Water Supply Act of 2012 has an appropriate title at the November
284, 2014, statewide general election, it is necessary that this act
29take effect immediately.
