An act to amend Section 44259 of the Education Code, relating to teacher credentialing.

Existing law establishes minimum requirements for the issuance of a preliminary multiple or single subject teaching credential by the Commission on Teacher Credentialing. SECTION 1.  

Section 44259 of the Education Code is amended
2to read:

44259.  

(a) Except as provided in subparagraphs (A) and (C)
4of paragraph (3) of subdivision (b), each program of professional
5preparation for multiple or single subject teaching credentials shall
6not include more than two years of, or the equivalent of two-fifths
7of a five-year program in, professional preparation.

8(b) The minimum requirements for the preliminary multiple or
9 single subject teaching credential are all of the following:

10(1) A baccalaureate degree or higher degree from a regionally
11accredited institution of postsecondary begin deleteeducation. Theend deletebegin insert education.
12Except as provided in subdivision (c) of Section 44227, the
13baccalaureate degree shall not be in professional education. Theend insert

14 commission shall encourage accredited institutions to offer
15undergraduate minors in education and special education to
16students who intend to become teachers.

17(2) Passage of the state basic skills proficiency test that is
18developed and administered by the commission pursuant to Section
19 44252.5.

20(3) Satisfactory completion of a program of professional
21preparation that has been accredited by the Committee on
22Accreditation on the basis of standards of program quality and
23effectiveness that have been adopted by the commission. In
24accordance with the commission’s assessment and performance
25standards, each program shall include a teaching performance
26assessment as set forth in Section 44320.2 that is aligned with the
27California Standards for the Teaching Profession. The commission
28shall ensure that each candidate recommended for a credential or
29certificate has demonstrated satisfactory ability to assist pupils to
30meet or exceed academic content standards for pupils adopted by
31the state boardbegin insert pursuant to Section 60605end insert. Programs that meet this
32requirement for professional preparation shall include any of the
33following:

P3    1(A) Integrated programs of subject matter preparation and
2professional preparation pursuant to subdivision (a) of Section
344259.1.

4(B) Postbaccalaureate programs of professional preparation,
5pursuant to subdivision (d) of Section 44259.1.

6(C) Internship programs of professional preparation, pursuant
7to Section 44321, Article 7.5 (commencing with Section 44325),
8Article 11 (commencing with Section 44380), and Article 3
9(commencing with Section 44450) of Chapter 3.

10(4) Study of alternative methods of developing English language
11skills, including the study of reading as described in subparagraphs
12(A) and (B), among all pupils, including those for whom English
13is a second language, in accordance with the commission’s
14standards of program quality and effectiveness. The study of
15reading shall meet the following requirements:

16(A) Commencing January 1, 1997, satisfactory completion of
17comprehensive reading instruction that is research-based and
18includes all of the following:

19(i) The study of organized, systematic, explicit skills including
20phonemic awareness, direct, systematic, explicit phonics, and
21decoding skills.

22(ii) A strong literature, language, and comprehension component
23with a balance of oral and written language.

24(iii) Ongoing diagnostic techniques that inform teaching and
25assessment.

26(iv) Early intervention techniques.

27(v) Guided practice in a clinical setting.

28(B) Forbegin delete theend delete purposes of this section, “direct, systematic, explicit
29phonics” means phonemic awareness, spelling patterns, the direct
30instruction of sound/symbol codes and practice in connectedbegin delete textend delete
31begin insert text, end insertand the relationship of direct, systematic, explicit phonics to
32the components set forth in clauses (i) to (v), inclusive, of
33subparagraph (A).

34A program for the multiple subjects credential also shall include
35the study of integrated methods of teaching language arts.

36(5) Completion of a subject matter program that has been
37approved by the commission on the basis of standards of program
38quality and effectiveness pursuant to Article 6 (commencing with
39Section 44310) or passage of a subject matter examination pursuant
40to Article 5 (commencing with Section 44280). The commission
P4    1shall ensure that subject matter standards and examinations are
2aligned with the academic content standards for pupils adopted by
3the state boardbegin insert pursuant to Section 60605end insert.

4(6) Demonstration of a knowledge of the principles and
5provisions of the Constitution of the United States pursuant to
6Section 44335.

7(7) Commencing January 1, 2000, demonstration, in accordance
8with the commission’s standards of program quality and
9effectiveness, of basic competency in the use of computers in the
10classroom as determined by one of the following:

11(A) Successful completion of a commission-approved program
12or course.

13(B) Successful passage of an assessment that is developed,
14approved, and administered by the commission.

15(c) The minimum requirements for the clear multiple or single
16subject teaching credential shall include all of the following
17requirements:

18(1) Possession of a valid preliminary teaching credential, as
19prescribed in subdivision (b), possession of a valid equivalent
20credential or certificate, or completion of equivalent requirements
21as determined by the commission.

22(2) Except as provided in paragraph (3), completion of a
23program of beginning teacher induction, including one of the
24following:

25(A) A program of beginning teacher support and assessment
26approved by the commission and the Superintendent pursuant to
27Section 44279.1, a provision of the Marian Bergeson Beginning
28Teacher Support and Assessment System.

29(B) An alternative program of beginning teacher induction that
30is provided by one or more local educational agencies and has
31been approved by the commission and the Superintendent on the
32basis of initial review and periodic evaluations of the program in
33relation to appropriate standards of credential program quality and
34effectiveness that have been adopted by the commission, the
35Superintendent, and the state board pursuant to this subdivision.
36The standards for alternative programs shall encourage innovation
37and experimentation in the continuous preparation and induction
38of beginning teachers.begin delete Anyend deletebegin insert Anend insert alternative program of beginning
39teacher induction that has met state standards pursuant to this
P5    1subdivision may apply for state funding pursuant to Sections
244279.1 and 44279.2.

3(C) An alternative program of beginning teacher induction that
4is sponsored by a regionally accredited college or university, in
5cooperation with one or more local school districts, that addresses
6the individual professional needs of beginning teachers and meets
7the commission’s standards of induction. The commission shall
8ensure that preparation and induction programs that qualify
9candidates for professional credentials extend and refine each
10beginning teacher’s professional skills in relation to the California
11Standards for the Teaching Profession and the academic content
12standards for pupils adopted by the state boardbegin insert pursuant to Section
1360605end insert

14(3) (A) If a candidate satisfies the requirements of subdivision
15(b), including completion of an accredited internship program of
16professional preparation, and if that internship program fulfills
17induction standards and is approved as set forth in this subdivision,
18the commission shall determine that the candidate has fulfilled the
19requirements of paragraph (2).

20(B) If an approved induction program is verified as unavailable
21to a beginning teacher, or if the beginning teacher is required under
22the federal No Child Left Behind Act of 2001 (20 U.S.C. Sec. 6301
23et seq.) to complete subject matter coursework to be qualified for
24a teaching assignment, the commission shall accept completion of
25an approved clear credential program after completion of a
26baccalaureate degree at a regionally accredited institution as
27fulfilling the requirements of paragraph (2). The commission shall
28adopt regulations to implement this subparagraph.

29(4) Experience that includes the application of knowledge and
30skills previously acquired in a preliminary credential program, in
31accordance with commission standards, that addresses the
32following:

33(A) Health education, including study of nutrition,
34cardiopulmonary resuscitation, and the physiological and
35sociological effects of abuse of alcohol, narcotics, and drugs and
36the use of tobacco. Training in cardiopulmonary resuscitation shall
37also meet the standards established by the American Heart
38Association or the American Red Cross.

P6    1(B) Field experience in methods of delivering appropriate
2educational services to pupils with exceptional needs in regular
3education programs.

4(C) Advanced computer-based technology, including the uses
5of technology in educational settings.

6(d) The commission shall develop and implement standards of
7program quality and effectiveness that provide for the areas of
8application listed in subparagraphs (A) to (C), inclusive, of
9paragraph (4) of subdivision (c), starting in professional preparation
10and continuing through induction.

11(e) A credential that was issuedbegin delete prior toend deletebegin insert beforeend insert January 1, 1993,
12shall remain in force as long as it is valid under the laws and
13regulations that were in effect on the date it was issued. The
14commissionbegin delete mayend deletebegin insert shall end insert not, by regulation, invalidate an otherwise
15valid credential, unless it issues to the holder of the credential, in
16substitution, a new credential authorized by another provision in
17this chapter that is no more restrictive than the credential for which
18it was substituted with respect to the kind of service authorized
19and the grades, classes, or types of schools in which it authorizes
20service.

21(f) A credential program that is approved by the commission
22begin deletemayend deletebegin insert shallend insert not deny an individual access to that program solely on
23the grounds that the individual obtained a teaching credential
24through completion of an internship program when that internship
25program has been accredited by the commission.

26(g) Notwithstanding this section, persons who were performing
27teaching services as of January 1, 1999, pursuant to the language
28of this section that was in effectbegin delete prior toend deletebegin insert beforeend insert that date, may
29continue to perform those services without complying with any
30requirements that may be added by the amendments adding this
31subdivision.

32(h) Subparagraphs (A) and (B) of paragraph (4) of subdivision
33(b) do not apply to any person who, as of January 1, 1997, holds
34a multiple or single subject teaching credential, or to any person
35enrolled in a program of professional preparation for a multiple
36or single subject teaching credential as of January 1, 1997, who
37subsequently completes that program. It is the intent of the
38Legislature that the requirements of subparagraphs (A) and (B) of
39paragraph (4) of subdivision (b) be applied only to persons who
