SB 238, as amended, Liu. Santa Monica Mountains Conservancy members: voting.
Existing law, the Santa Monica Mountains Conservancy Act, establishes the Santa Monica Mountains Conservancy and prescribes the membership, functions, and duties of the conservancy with regard to the protection and preservation of lands within the Santa Monica Mountains Zone, as defined. Existing law requires the conservancy be composed of 9 voting members and 3 ex officio members, as specified, and requires the Supervisor of the Angeles National Forest to serve as an ex officio, nonvoting member of the conservancy.
This bill would authorize the Supervisor of the Angeles National Forest to vote on a manner related to a project located within, adjacent to, or substantially affecting, the Angeles National Forest.

The people of the State of California do enact as follows:
Section 33200 of the Public Resources Code is
2amended to read:
(a) The Santa Monica Mountains Conservancy is
2hereby established within thebegin insert Naturalend insert Resources Agency. The
3conservancy is composed of nine voting members and three ex
4officio members. The voting members are as follows:
5(1) The Superintendent of the Santa Monica Mountains National
6Recreation Area, or his or her designee.
7(2) A member representing the City of Los Angeles, appointed
8by the mayor with the approval of the city council.
9(3) Three public members who shall be residents of either the
10County of Los Angeles or the County of Ventura, one of whom
11shall be appointed by the Governor, one of whom shall be
12
appointed by the Senate Committee on Rules, and one of whom
13shall be appointed by the Speaker of the Assembly. At least one
14of the public members shall reside within the San Fernando Valley
15statistical area, as defined in Section 11093 of the Government
16Code. The seat of a public member shall be deemed vacant if the
17member changes his or her residence to a county other than Los
18Angeles or Ventura County.
19(4) An elected official who is a representative nominated by the
20city councils of those cities which have at least 75 percent of their
21areas within the zone who shall be appointed by the Board of
22Supervisors of the County of Los Angeles or a member appointed
23by the Board of Supervisors of the County of Los Angeles, or that
24member’s designee.
25(5) An elected
official who is either a member of the City
26Council of the City of Thousand Oaks or a member of the Board
27of Supervisors of the County of Ventura and who shall be
28appointed by the Board of Supervisors of the County of Ventura,
29or the elected official’s designee.
30(6) The Secretary of thebegin insert Naturalend insert Resources Agency or an
31employee of the agency designated by the secretary.
32(7) The Superintendent of the Angeles District of the Department
33of Parks and Recreation, or his or her designee.
34(b) (1) (A) The California Coastal Commission and the State
35Coastal Conservancy shall each appoint an ex
officio member who
36shall be either a member or employee of their respective agency.
37The ex officio member appointed by the California Coastal
38Commission and the State Coastal Conservancy shall be nonvoting
39members, except that the ex officio member appointed by the State
P3 1Coastal Conservancy may vote on any matter relating to a project
2undertaken within the coastal zone portion of the zone.
3(B) On the 10th working day after certification pursuant to
4Chapter 6 (commencing with Section 30500) of Division 20 of
5any local coastal program, or any portion thereof, for any portion
6of the zone, the ex officio member appointed by the California
7Coastal Commission may vote on any matter relating to a project
8undertaken within the coastal zone portion of the zone and the ex
9officio member appointed by the State Coastal Conservancy may
10not vote on
the matter.
11(2) (A) Except as provided in subparagraph (B), the Supervisor
12of the Angeles National Forest shall also serve as an ex officio,
13nonvoting member of the conservancy.
14(B) The Supervisor of the Angeles National Forest may vote
15on a matter relating to a project located within, adjacent to, or
16substantially affecting, the Angeles National Forest.
17(c) The chairperson and vice chairperson of the conservancy
18shall be selected by the voting members of the conservancy for a
19one-year term. A majority of the total authorized and appointed
20voting membership of the conservancy constitutes a quorum for
21the transaction of any business under this division.
22(d) (1) The following members of the conservancy shall be
23compensated for attendance at regular meetings of the conservancy
24at the rate of one hundred dollars ($100) per day:
25(A) The public members.
26(B) The member appointed by the Board of Supervisors of the
27County of Los Angeles or that member’s designee, unless the
28member or designee is also a member of the board of supervisors,
29in which case no compensation shall be paid.
30(C) The member appointed by the Board of Supervisors of the
31County of Ventura or that member’s designee, unless the member
32or designee is also a member of a board of supervisors, in which
33case no compensation shall be paid.
34(D) The members appointed by the State Coastal Conservancy
35and the California Coastal Commission if these members are not
36employees of their respective agency or are not full-time
37compensated elected officials.
38(E) The appointed member representing the City of Los Angeles.
P4 1(2) All members of the conservancy shall be reimbursed for
2actual and necessary expenses, including travel expenses, incurred
3in the performance of their duties.
