Existing law provides funding for various career technical education programs, including regional occupational centers and programs, specialized secondary programs, partnership academies, and agricultural career technical education programs.

The bill would require an RCTEC to comply with specified requirements as a condition of receiving funds, including, among others, certifying to the State Department of Education that each course within a sequence is aligned to the California Career Technical Education Standards. The bill would require the Superintendent to incorporate various factors and quality indicators into the accountability measures for regional occupational centers and programs and other related programs, and would require the Superintendent to develop an evaluation instrument to evaluate the programs within each RCTEC commencing with the 2015-16 school year.end insert

(a) For the 2013-14 fiscal year:
4(1) Notwithstanding Section 42605 or any other law, from funds
5appropriated in Items 6110-105-0001, 6110-122-0001,
66110-166-0001, and 6110-167-001 of Section 2.00 of the annual
7Budget Act, the Superintendent shall apportion an amount to each
8county office of education in the same relative proportion of
9funding that the county office of education, school districts, and
10joint powers agencies within that county received from funds
11appropriated for those items in the 2012-13 fiscal year.
12(2) From the funds described in paragraph (1), each county
13office of education shall allocate to regional occupational centers
14and programs in accordance with
Section 52321, school districts,
15and county offices of education a proportion of these funds in the
16same relative proportion of funding that these entities received in
17the 2012-13 fiscal year.
18(b) For the 2014-15 fiscal year and each fiscal year thereafter,
19the allocation made to each regional occupational center and
20program, school district, and county office of education shall be
21adjusted annually for increases in costs of living by adding the
P3 1product of the prior year allocation and the index described in
2paragraph (2) of subdivision (b) of Section 42238.1 to the prior
3year allocation.
4(c) (1) (A) Local educational agencies that operate career
5technical education programs may form into a Regional Career
6Technical Education Collaborative (RCTEC) for purposes of this
7paragraph.
8(B) Notwithstanding any other law, within an RCTEC formed
9pursuant to subparagraph (A), two or more of the following entities
10may enter into an agreement to use funding received from Items
116110-105-0001, 6110-122-0001, 6110-166-0001, and
126110-167-0001 of Section 2.00 of the annual Budget Act to share
13in the cost of developing and maintaining a career technical
14education program based upon curricula aligned with California
15Career Technical Education Standards and Common Core State
16Standards:
17(i) The governing board, or its designee, of a regional
18occupational center or program.
19(ii) The chair or designee of a schoolsite Agricultural Advisory
20Committee.
21(iii) A site director of a California partnership academy.
22(iv) The superintendent or
governing board of a school district,
23or its appointee.
24(C) The agreement formed pursuant to subparagraph (B) shall
25remain in effect for one year, and shall be renewable annually
26thereafter with the consent of the parties to the agreement.
27(2) Notwithstanding any other law, funds allocated pursuant to
28this section and funds subject to an agreement pursuant to
29subparagraph (B) may be expended only to ensure the development
30and maintenance of a high-quality career technical education
31program.
32(3) In the absence of an agreement pursuant to subparagraph
33(B), funds appropriated in Items 6110-122-0001, 6110-166-0001,
34and 6110-167-0001 of Section 2.00 of the annual Budget Act may
35be expended only for the purposes of the programs for which they
36were appropriated.
37(d) (1) As a condition of receipt of funds pursuant to this
38section, the governing board of each regional occupational center
39or program, in collaboration with individuals representing partner
40school districts, California partnership academies, agricultural
P4 1career technical education programs, and other career technical
2education programs within each RCTEC, shall do all of the
3following:
4(A) Develop a plan for establishing a sequence of courses by
5July 1, 2015. This plan shall not be in conflict with the plan
6developed pursuant to Section 52302, and, to the extent it is
7appropriate, shall be based on that plan and shall update that
8plan.
9(B) Certify to the department by September 1, 2016, that each
10sequence of courses specified in the plan required by this
11subdivision has been developed.
12(C) Report each new sequence of courses and each modification
13to existing sequences to the department no later than September
141 of the fiscal year in which the changes are implemented.
15(D) Certify to the department that each course within a sequence
16is aligned to the California Career Technical Education Standards.
17(E) Certify to the department that each course, where
18appropriate, is aligned to the Common Core State Standards.
19(2) Programs receiving funds pursuant to this section shall
20collect and report data as required by the department to prepare
21and update an accountability measure as provided in existing
22statute and in subdivision (e).
23(e) (1) To determine the quality and effectiveness of a career
24technical
education course of study or sequence of career technical
25education courses funded pursuant to subdivisions (a) and (b), the
26Superintendent shall incorporate into the accountability measures
27for regional occupational centers and programs, agricultural
28career technical education programs, partnership academies, and
29specialized secondary education programs a uniform accountability
30metric based on any career-ready standards adopted pursuant to
31the federal Elementary and Secondary Education Act (20 U.S.C.
32Sec. 6301 et seq.) and the following program quality indicators
33in the California State Plan for Career Technical Education:
34(A) Leadership at all levels.
35(B) High-quality curriculum and instruction aligned with state
36standards.
37(C) Career exploration and guidance.
38(D) Pupil support and leadership development.
39(E) Industry partnerships and advisory committees.
P5 1(F) System alignment and coherence, including postsecondary
2education institution involvement.
3(G) After school, extended day, and out-of-school opportunities.
4(H) Reflection of labor market demands and provision of current
5equipment.
6(I) Skilled faculty and professional development.
7(J) Career technical education outreach and communication.
8(K) Data-based pupil evaluation, accountability, and continuous
9improvement.
10(2) In addition to the indicators listed in paragraph (1), the
11accountability measures shall include the rates at which pupils
12complete a course of study or sequence of career technical
13education courses that provide the skills and knowledge necessary
14to attain entry-level employment in business or industry, or to
15pursue postsecondary education after those pupils graduate from
16high school. The pupil data shall include, but are not necessarily
17limited to, all of the following:
18(A) The number of pupils completing high school.
19(B) The number of pupils earning an industry-recognized
20certification or licensure or other measures of technical skill
21attainment.
22(C) The number of pupils completing career technical education
23courses and completing a career technical
education program of
24study, consisting of a sequence of two or more career technical
25education courses.
26(D) The number of pupils employed and the types of businesses
27in which they are employed.
28(E) The number of pupils enrolled in postsecondary education
29or apprenticeship programs, or serving in the Armed Forces.
30(3) The accountability measures shall also include data on the
31industry certifications available for pupils to complete.
32(f) The Superintendent shall develop an evaluation instrument
33to evaluate the programs within each RCTEC commencing with
34the 2015-16 school year, and annually thereafter.
35(1) The evaluation shall be based on the uniform metric
36developed pursuant to subdivision
(e) and may be based on the
37existing evaluation instrument described in the California County
38Superintendents Educational Services Association Course of Study
39document.
P6 1(2) The Superintendent shall collaborate with stakeholders
2including, but not limited to, representatives from:
3(A) Regional occupational centers and programs.
4(B) California partnership academies.
5(C) Agricultural career technical education programs.
6(D) County offices of education.
7(E) The California School Boards Association.
8(F) The Association of California School Administrators.
9(G) The California Teachers Association.
10(H) The California Manufacturers and Technology Association.
11(I) The Building Trades Association.
12(3) The completed evaluation instrument shall be reviewed by
13an independent local review council comprised of representatives
14from the following:
15(A) A county office of education.
16(B) A school district.
17(C) An industry advisory committee, advisory board, or member
18of local business and industry.
19(D) The Regional Occupational Centers and Programs Joint
20Powers
Authority, where applicable.
21(E) Postsecondary education.
22(F) A local workforce investment board.
23(4) The evaluation instrument shall be submitted to the
24department for review.
Section 52334.7 is added to the Education Code,
26to read:
(a) Notwithstanding Section 42605 or any other law,
28for the 2015-16 fiscal year and each subsequent fiscal year, from
29funds appropriated in Items 6110-105-0001, 6110-122-0001,
306110-166-0001, and 6110-167-0001 of Section 2.00 of the annual
