SB 660, as amended, Hancock. Career technical education: funding.
Existing law provides funding for various career technical education programs, including regional occupational centers and programs, specialized secondary programs, partnership academies, and agricultural career technical education programs.
This bill would, for the 2013-14 fiscal year, require the Superintendent of Public Instruction, using funds appropriated in the annual Budget Act for regional occupational centers and programs, to apportion from the amounts provided in the annual Budget Act for those purposes an amount to each county office of education in the same relative proportion of funding that the county office of education, school districts, and joint powers agencies within that county received in the 2012-13 fiscal year for those purposes. The bill would, for the 2014-15 fiscal year and each fiscal year thereafter, require the
allocation made to those entities to be adjusted annually for increases in cost of livingbegin insert and for purposes of equalizing theend insertbegin insert per pupil allocationsend insert, as specified. The bill would authorize local educational agencies that operate career technical education programs to form into a Regional Career Technical Education Collaborativebegin delete (RCTEC)end delete to share in the cost of developing and maintaining a career technical education program based upon curricula aligned with the California Career Technical Education Standards and Common Core State Standards, and would require the apportioned funds to be expended only to ensure the development and maintenance of a high-quality career technical education program. The bill would requirebegin delete an RCTECend deletebegin insert
the governing board of each regional occupational center or program, California partnership academies, agricultural career technical education programs, and other career technical education programs,end insert to comply with specified requirements as a condition of receiving funds, including, among others, certifying to the State Department of Education that each course within a sequence is aligned to the California Career Technical Education Standards. The bill would require the Superintendent to incorporate various factors and quality indicators into the accountability measures for regional occupational centers and programs and other related programs, and would require the Superintendent to develop an evaluation instrument to evaluate the programs within eachbegin delete RCTECend deletebegin insert regional career technical education collaborativeend insert
commencing with the 2015-16 school year.

The people of the State of California do enact as follows:
Section 52334.7 is added to the Education Code,
2to read:
(a) For the 2013-14 fiscal year:
4(1) Notwithstanding Section 42605 or any other law, from funds
5appropriated in Items 6110-105-0001, 6110-122-0001,
66110-166-0001, andbegin delete 6110-167-001end deletebegin insert 6110-167-0001end insert of Section 2.00
7of the annual Budget Act, the Superintendent shall apportion an
8amount to each county office of education in the same relative
9proportion of funding that the county office of education, school
10districts, and joint powers agencies within that county received
11from funds appropriated for those items
in the 2012-13 fiscal year.
12(2) From the funds described in paragraph (1), each county
13office of education shall allocate to regional occupational centers
14and programs in accordance with Section 52321, school districts,
15and county offices of education a proportion of these funds in the
16same relative proportion of funding that these entities received in
17the 2012-13 fiscal year.

12(2) For purposes of equalizing the provided per pupil
13allocations, the prior year allocation made pursuant to this section
14shall be adjusted pursuant to Section 52334.8.
15(c) (1) (A) Local educational agencies that operate career
16technical education programs may form into a Regional Career
17Technical Education Collaborative (RCTEC) for purposes of this
18paragraph.
19(B) Notwithstanding any other law, within an RCTEC formed
20pursuant to subparagraph (A), two or more of the following entities
21may enter into an agreement to use
funding received from Items
226110-105-0001, 6110-122-0001, 6110-166-0001, and
236110-167-0001 of Section 2.00 of the annual Budget Act to share
24in the cost of developing and maintaining a career technical
25education program based upon curricula aligned with California
26Career Technical Education Standards and Common Core State
27Standards:
28(i) The governing board, or its designee, of a regional
29occupational center or program.
30(ii) The chair or designee of a schoolsite Agricultural Advisory
31Committee.
32(iii) A site director of a California partnership academy.
33(iv) The superintendent or governing board of a school district,
34or its appointee.
35(C) The agreement formed pursuant to subparagraph (B) shall
36remain in effect for one year, and shall be renewable annually
37thereafter with the consent of the parties to the agreement.
38(2) Notwithstanding any other law, funds allocated pursuant to
39this section and funds subject to an agreement pursuant to
40subparagraph (B) may be expended only to ensure the development
P4 1and maintenance of a high-quality career technical education
2program.
3(3) In the absence of an agreement pursuant to subparagraph
4(B), funds appropriated in Items 6110-122-0001, 6110-166-0001,
5and 6110-167-0001 of Section 2.00 of the annual Budget Act may
6be expended only for the purposes of the programs for which they
7were appropriated.
8(d) (1) As a condition of receipt of funds pursuant to this
9section, the governing board of each regional occupational center
10or program,begin delete in collaboration with individuals representing partner California partnership academies, agricultural
11school districts,end delete
12career technical education programs, and other career technical
13educationbegin delete programs within each RCTEC,end deletebegin insert programs,end insert shall do all
14of the following:
15(A) Develop a plan for establishing a sequence of courses by
16July 1, 2015. This plan shall not be in conflict with
the plan
17developed pursuant to Section 52302, and, to the extent it is
18appropriate, shall be based on that plan and shall update that plan.
19(B) Certify to the department by September 1, 2016, that each
20sequence of courses specified in the plan required by this
21subdivision has been developed.
22(C) Report each new sequence of courses and each modification
23to existing sequences to the department no later than September
241 of the fiscal year in which the changes are implemented.
25(D) Certify to the department that each course within a sequence
26is aligned to the California Career Technical Education Standards.
27(E) Certify to the department that each course, where
28appropriate,
is aligned to the Common Core State Standards.
29(2) Programs receiving funds pursuant to this section shall
30collect and report data as required by the department to prepare
31and update an accountability measure as provided in existing statute
32and in subdivision (e).
33(e) (1) To determine the quality and effectiveness of a career
34technical education course of study or sequence of career technical
35education courses funded pursuant to subdivisions (a) and (b), the
36Superintendent shall incorporate into the accountability measures
37for regional occupational centers and programs, agricultural career
38technical education programs, partnership academies, and
39specialized secondary education programs a uniform accountability
40metric based on any career-ready standards adopted
pursuant to
P5 1the federal Elementary and Secondary Education Actbegin insert of 1965end insert (20
2U.S.C. Sec. 6301 et seq.) and the following program quality
3indicators in the California State Plan for Career Technical
4Education:
5(A) Leadership at all levels.
6(B) High-quality curriculum and instruction aligned with state
7standards.
8(C) Career exploration and guidance.
9(D) Pupil support and leadership development.
10(E) Industry partnerships and advisory committees.
11(F) System alignment and coherence, including postsecondary
12education institution involvement.
13(G) After school, extended day, and out-of-school opportunities.
14(H) Reflection of labor market demands and provision of current
15equipment.
16(I) Skilled faculty and professional development.
17(J) Career technical education outreach and communication.
18(K) Data-based pupil evaluation, accountability, and continuous
19improvement.
20(2) In addition to the indicators listed in paragraph (1), the
21accountability measures shall include the rates at which pupils
22complete
a course of study or sequence of career technical
23education courses that provide the skills and knowledge necessary
24to attain entry-level employment in business or industry, or to
25pursue postsecondary education after those pupils graduate from
26high school. The pupil data shall include, but are not necessarily
27limited to, all of the following:
28(A) The number of pupils completing high school.
29(B) The number of pupils earning an industry-recognized
30certification or licensure or other measures of technical skill
31attainment.
32(C) The number of pupils completing career technical education
33courses and completing a career technical education program of
34study, consisting of a sequence of two or more career technical
35education
courses.
36(D) The number of pupils employed and the types of businesses
37in which they are employed.
38(E) The number of pupils enrolled in postsecondary education
39or apprenticeship programs, or serving in thebegin insert United Statesend insert Armed
40Forces.
P6 1(3) The accountability measures shall also include data on the
2industry certifications available for pupils to complete.
3(f) The Superintendent shall develop an evaluation instrument
4to evaluate the programs within each RCTEC commencing with
5the 2015-16 school year, and annually thereafter.
6(1) The evaluation shall be based on the uniformbegin insert accountabilityend insert
7 metric developed pursuant to subdivision (e) and may be based on
8the existing evaluation instrument described in the California
9County Superintendents Educational Services Association Course
10of Study document.
11(2) The Superintendent shall collaborate with stakeholders
12including, but not limited to, representatives from:
13(A) Regional occupational centers and programs.
14(B) California partnership academies.
15(C) Agricultural career technical education programs.
16(D) County offices of education.
17(E) The California School Boards Association.
18(F) The Association of California School Administrators.
19(G) The California Teachers Association.
20(H) The California Manufacturers and Technology Association.
21(I) The Building Trades Association.
22(3) The completed evaluation instrument shall be reviewed by
23an independent local review council comprised of representatives
24from the following:
25(A) A county office of education.
26(B) A school district.
27(C) An industry advisory committee, advisory board, or member
28of local business and industry.
29(D) The Regional Occupational Centers and Programs Joint
30Powers Authority, where applicable.
31(E) Postsecondary education.
32(F) A local workforce investment board.
33(4) The evaluation instrument shall be submitted to the

(a) The Superintendent shall compute an equalization
38adjustment for each regional occupational center or program,
39school district, and county office of education receiving an
40allocation of funds pursuant to Section 52334.7, so that the
P7 1allocation of moneys to those entities pursuant to that section per
2unit of average daily attendance for any fiscal year is not less than
3the allocation of those moneys to those entities pursuant to that
4section per unit of average daily attendance for that same fiscal
5year above which fall not more than 10 percent of the total
6statewide units of average daily attendance for entities receiving
7an allocation of funds pursuant to that section.
8(b) For each regional occupational center or program, school
9
district, and county office of education receiving an allocation of
10funds pursuant to Section 52334.7, the Superintendent shall
11compute an adjustment to the fiscal year allocation by multiplying
12the amount computed for each regional occupational center or
13program, school district, and county office of education pursuant
14to subdivision (a) by the average daily attendance generated by
15that regional occupational center or program, school district, and
16county office of education.
