Existing law provides funding for various career technical education programs, including regional occupational centers and programs, specialized secondary programs, partnership academies, and agricultural career technical education programs.
This bill wouldbegin delete, for the 2013-14 fiscal year, require the Superintendent of Public Instruction, using funds appropriated in the annual Budget Act for regional occupational centers and programs, to apportion from the amounts provided in the annual Budget Act for those purposes an amount to each county office of education in the same relative proportion of funding that the county office of education, school districts, and joint powers agencies within that county received in the 2012-13 fiscal year for those purposes. The bill would, for the 2014-15 fiscal year and each fiscal year thereafter, require the
allocation made to those entities to be adjusted annually for increases in cost of living and for purposes of equalizing the per pupil allocations, as specified. The bill would authorize local educational agencies that operate career technical education programs to form into a Regional Career Technical Education Collaborative to share in the cost of developing and maintaining a career technical education program based upon curricula aligned with the California Career Technical Education Standards and Common Core State Standards, and would require the apportioned funds to be expended only to ensure the development and maintenance of a high-quality career technical education program. The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

The people of the State of California do enact as follows:
Section 52334.7 is added to the Education Code,
2to read:
(a) For the 2013-14 fiscal year:
4(1) Notwithstanding Section 42605 or any other law, from funds
5appropriated in Items 6110-105-0001, 6110-122-0001,
66110-166-0001, and 6110-167-0001 of Section 2.00 of the annual
7Budget Act, the Superintendent shall apportion an amount to each
8county office of education in the same relative proportion of
9funding that the county office of education, school districts, and
10joint powers agencies within that county received from funds
11appropriated for those items in the 2012-13 fiscal year.
12(2) From the funds described in paragraph (1), each county
13office of education shall allocate
to regional occupational centers
14and programs in accordance with Section 52321, school districts,
15and county offices of education a proportion of these funds in the
16same relative proportion of funding that these entities received in
17the 2012-13 fiscal year.
18(b) For the 2014-15 fiscal year and each fiscal year thereafter,
19and from the funds appropriated in the annual Budget Act
20specifically for the purposes described in paragraphs (1) and (2),
21the allocation made to each regional occupational center and
22program, school district, and county office of education shall be
23adjusted annually for the following purposes:
24(1) For purposes of providing increases in costs of living, the
25product of the prior year allocation made pursuant to this section
26and the index described in paragraph
(2) of subdivision (b) of
27Section 42238.1 shall be added to the prior year allocation.
28(2) For purposes of equalizing the provided per pupil allocations,
29the prior year allocation made pursuant to this section shall be
30adjusted pursuant to Section 52334.8.
31(c) (1) (A) Local educational agencies that operate career
32technical education programs may form into a Regional Career
33Technical Education Collaborative (RCTEC) for purposes of this
34paragraph.
35(B) Notwithstanding any other law, within an RCTEC formed
36pursuant to subparagraph (A), two or more of the following entities
37may enter into an agreement to use funding received from Items
386110-105-0001, 6110-122-0001,
6110-166-0001, and
P4 16110-167-0001 of Section 2.00 of the annual Budget Act to share
2in the cost of developing and maintaining a career technical
3education program based upon curricula aligned with California
4Career Technical Education Standards and Common Core State
5Standards:
6(i) The governing board, or its designee, of a regional
7occupational center or program.
8(ii) The chair or designee of a schoolsite Agricultural Advisory
9Committee.
10(iii) A site director of a California partnership academy.
11(iv) The superintendent or governing board of a school district,
12or its appointee.
13(C) The
agreement formed pursuant to subparagraph (B) shall
14remain in effect for one year, and shall be renewable annually
15thereafter with the consent of the parties to the agreement.
16(2) Notwithstanding any other law, funds allocated pursuant to
17this section and funds subject to an agreement pursuant to
18subparagraph (B) may be expended only to ensure the development
19and maintenance of a high-quality career technical education
20program.
21(3) In the absence of an agreement pursuant to subparagraph
22(B), funds appropriated in Items 6110-122-0001, 6110-166-0001,
23and 6110-167-0001 of Section 2.00 of the annual Budget Act may
24be expended only for the purposes of the programs for which they
25were appropriated.
26(d) (1) As a condition of receipt of funds pursuant to this
27section, the governing board of each regional occupational center
28or program, California partnership academies, agricultural career
29technical education programs, and other career technical education
30programs, shall do all of the following:
31(A) Develop a plan for establishing a sequence of courses by
32July 1, 2015. This plan shall not be in conflict with the plan
33developed pursuant to Section 52302, and, to the extent it is
34appropriate, shall be based on that plan and shall update that plan.
35(B) Certify to the department by September 1, 2016, that each
36sequence of courses specified in the plan required by this
37subdivision has been developed.
(a) Each county superintendent of schools, subject
39to paragraph (2) of subdivision (k) of Section 2575 for purposes
40of regional occupational centers or programs offered by the county
P5 1office of education, and each school district, subject to paragraph
2(7) of subdivision (a) of Section 42238.03 for purposes of regional
3occupational centers or programs, shall do all of the following:

30the federal Elementary and Secondary Education Act of 1965 (20
31U.S.C. Sec. 6301 et seq.) and the following program quality
32indicators in the California State Plan for Career Technical
33Education:
34(A) Leadership at all levels.
35(B) High-quality curriculum and instruction aligned with state
36standards.
37(C) Career exploration and guidance.
38(D) Pupil support and leadership development.
39(E) Industry partnerships and advisory committees.
P6 1(F) System alignment and coherence, including postsecondary
2education institution
involvement.
3(G) After school, extended day, and out-of-school opportunities.
4(H) Reflection of labor market demands and provision of current
5equipment.
6(I) Skilled faculty and professional development.
7(J) Career technical education outreach and communication.
8(K) Data-based pupil evaluation, accountability, and continuous
9improvement.
10(2) In addition to the indicators listed in paragraph (1), the
11accountability measures shall include the rates at which pupils
12complete a course of study or sequence of career technical
13education courses that provide the skills and knowledge necessary
14to attain entry-level employment in
business or industry, or to
15pursue postsecondary education after those pupils graduate from
16high school. The pupil data shall include, but are not necessarily
17limited to, all of the following:
18(A) The number of pupils completing high school.
19(B) The number of pupils earning an industry-recognized
20certification or licensure or other measures of technical skill
21attainment.
22(C) The number of pupils completing career technical education
23courses and completing a career technical education program of
24study, consisting of a sequence of two or more career technical
25education courses.
26(D) The number of pupils employed and the types of businesses
27in which they are employed.
28(E) The number of pupils
enrolled in postsecondary education
29or apprenticeship programs, or serving in the United States Armed
30Forces.
31(3) The accountability measures shall also include data on the
32industry certifications available for pupils to complete.

6not limited to, representatives from:
7(A) Regional occupational centers and programs.
8(B) California partnership academies.
9(C) Agricultural career technical education programs.
10(D) County offices of education.
11(E) The California School Boards Association.
12(F) The Association of California School Administrators.
13(G) The California Teachers Association.
14(H) The California Manufacturers and Technology Association.
15(I) The Building Trades Association.
16(3) The completed evaluation instrument shall be reviewed by
17an independent local review council comprised of representatives
18from the following:
19(A) A county office of education.
20(B) A school district.
21(C) An industry advisory committee, advisory board, or member
22of local business and industry.
23(D) The Regional Occupational Centers and Programs Joint
24Powers Authority, where applicable.
25(E) Postsecondary education.
26(F) A local workforce investment board.
27(4) Thebegin insert completedend insert evaluation instrument shall be submitted to
28the department.
Section 52334.8 is added to the Education Code, to
30read:
(a) The Superintendent shall compute an equalization
32adjustment for each regional occupational center or program, school
33district, and county office of education receiving an allocation of
34funds pursuant to Section 52334.7, so that the allocation of moneys
35to those entities pursuant to that section per unit of average daily
36attendance for any fiscal year is not less than the allocation of those
37moneys to those entities pursuant to that section per unit of average
38daily attendance for that same fiscal year above which fall not
39more than 10 percent of the total statewide units of average daily
P8 1attendance for entities receiving an allocation of funds pursuant
2to that section.
3(b) For each regional occupational center or program, school
4
district, and county office of education receiving an allocation of
5funds pursuant to Section 52334.7, the Superintendent shall
6compute an adjustment to the fiscal year allocation by multiplying
7the amount computed for each regional occupational center or
8program, school district, and county office of education pursuant
9to subdivision (a) by the average daily attendance generated by
10that regional occupational center or program, school district, and
11county office of education.
If the Commission on State Mandates determines that
13this act contains costs mandated by the state, reimbursement to
14local agencies and school districts for those costs shall be made
15pursuant to Part 7 (commencing with Section 17500) of Division
164 of Title 2 of the Government Code.
