SB 850, as amended, Block. Public postsecondary education: community college districts: baccalaureate degree pilot program.
Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. Existing law requires the board of governors to appoint a chief executive officer, to be known as the Chancellor of the California Community Colleges. Existing law establishes community college districts, administered by governing boards, throughout the state, and authorizes these districts to provide instruction to students at the community college campuses maintained by the districts.
Existing law requires community colleges to offer instruction through, but not beyond, the 2nd year of college and authorizes community colleges to grant associate degrees in arts and science.

would, commencing January 1, 2015,end insert authorize the board of governors, in consultation with the California State University and the University of California, to establish abegin insert statewideend insert baccalaureate degree pilot program at not more thanbegin delete 20end deletebegin insert 15end insert community college districts, to be determined by the chancellor and approved by the board of governors, which would authorize each participatingbegin delete campus within theend delete
district to offer one type of baccalaureatebegin delete degree,end deletebegin insert degree at one campus within the district,end insert as specified. The bill would require abegin insert districtend insert baccalaureate degree pilot program tobegin delete expire 8 years after the establishment of the program.end deletebegin insert commence by the beginning of the 2017-18 academic year, and would require a student participating in a baccalaureate degree pilot program to complete his or degree by the end of the 2022-23 academic year.end insert The bill would requirebegin delete aend delete
participating community collegebegin delete districtend deletebegin insert districtsend insert to meet specified requirements, including, but not limited to, offering baccalaureate degreesbegin insert not offered by the California State University or the University of California, andend insert in subject areas with unmet workforce needs, asbegin delete specified, and submitting a report to the chancellor at least one year prior to the expiration of the baccalaureate degree pilot program or one year after the first graduating class, whichever occurs first, that would evaluate specified factors.end deletebegin insert specified.end insert
This bill would also require the governing board of a participating community college district to submit certain information for review by the chancellor and approval by the board of governors, including thebegin delete proposed governance system ofend deletebegin insert administrative plan forend insert the baccalaureate degree pilotbegin delete program, and would authorize the governing board of a community college district to enter into agreements with local businesses and agencies to provide educational services to students participating in a baccalaureate degree pilot program.end deletebegin insert program. The bill would provide that the Department of Finance and the Legislative
Analyst’s Office shall jointly conduct a statewide evaluation of the statewide baccalaureate degree pilot program implemented under this article, as specified, and to report the results of the evaluation, in writing, to the Legislature and the Governor on or before July 1, 2021.end insert The bill would provide that the board of governors shall developbegin insert,end insert and adopt by regulationbegin insert,end insert a funding model for the support of thebegin insert statewideend insert baccalaureate degree pilotbegin delete programs,end deletebegin insert programend insert as specified.
This bill would make these provisions inoperative on July 1, 2023, and would repeal the provisions on January 1, 2024.

The people of the State of California do enact as follows:
The Legislature finds and declares all of the
2following:
3(a) California needs to produce one million more baccalaureate
4degrees than the state currently produces to remain economically
5competitive in the coming decades.
6(b) The 21st century workplace increasingly demands a higher
7level of education in applied fields.
8(c) There is demand for education beyond the associate degree
9level in specific academic disciplines that is not currently being
10met by California’s four-year public institutions.
11(d) Community colleges can help fill the gaps in our higher
12education system by granting baccalaureate degrees in a limited
13number of specific areas in order to meet a growing demand for a
14skilled workforce.
15(e) These baccalaureate programs will be limited and will not
16in any way detract from the community colleges’ traditional
17mission to advance California’s economic growth and global
18competitiveness through education, training, and services that
19contribute to continuous workforce improvement, nor will these
20programs unnecessarily duplicate similar programs offered by
21nearby public four-year institutions.
22(f) Community colleges can provide a quality baccalaureate
23education to their students, enabling place-bound local students
24and military veterans the opportunity to earn the baccalaureate
25degree needed for new job opportunities and promotion.
26(g) Twenty-one other states, from Florida to Hawaii, already
27allow their community colleges to offer baccalaureate degrees.
28California is one of the most innovative states in the nation, and
29the California Community Colleges will use that same innovative
30spirit to produce more professionals in health, biotechnology,
31public safety, and other needed fields.
Article 3 (commencing with Section 78040) is added
33to Chapter 1 of Part 48 of Division 7 of Title 3 of the Education
34Code, to read:
For purposes of this article, “district” means any
4community college district identified by the Chancellor of the
5California Community Colleges as participating in thebegin insert statewideend insert
6 baccalaureate degree pilot program. Eachbegin insert participatingend insert district
7may establishbegin insert oneend insert baccalaureate degree pilotbegin delete programsend deletebegin insert
programend insert
8 pursuant to Section 78041.
Notwithstanding Section 66010.4,begin insert and commencing
10January 1, 2015,end insert the Board of Governors of the California
11Community Colleges, in consultation with the California State
12University and the University of California, may authorize the
13establishment ofbegin insert districtend insert baccalaureate degree pilot programs that
14meet all of the eligibility requirements set forth in Section 78042.
15Abegin insert districtend insert pilot program established pursuant to thisbegin delete section shall begin insert
article
16expire eight years after the establishment of the program.end delete
17shall commence no later than the 2017-18 academic year. A
18student participating in a baccalaureate pilot program shall
19complete his or her degree by the end of the 2022-23 academic
20year.end insert For purposes of this section, a pilot programbegin delete is establishedend delete
21begin insert commencesend insert when the first class of students begins the program.
22Thebegin insert statewideend insert baccalaureate degree pilot program shall consist of
23a maximum ofbegin delete twentyend deletebegin insert fifteenend insert districts, to be determined by the
24Chancellor of the California Community
Colleges and authorized
25by the Board of Governors of the California Community Colleges.
(a) A district shall seek approval to offerbegin insert aend insert
27 baccalaureate degreebegin delete programsend deletebegin insert programend insert through the appropriate
28accreditation body.
29(b) When seeking authorization from the Board of Governors
30of the California Community Colleges, a district shall maintain
31the primary mission of the California Community Colleges
32specified in paragraph (3) of subdivision (a) of Section 66010.4.
33The district, as part of the
baccalaureate degree pilot program,
34shall have the additional mission to provide high-quality
35undergraduate education at an affordable price for students and
36the state.
37(c) A district shall not offer more than one type of baccalaureate
38begin delete degree per campus, end deletebegin insert degree,end insert as determined by the governing board
39of the district and approved by the Governing Board of the
P5 1California Community Colleges, and subject to the following
2limitations:
3(1) A district shall identify and document unmet workforce
4needs in the subjectbegin delete areasend deletebegin insert
areaend insert of the baccalaureatebegin delete degreesend deletebegin insert degreeend insert
5 to be offered and offer a baccalaureate degree at a campus in a
6subject area with unmet workforce needs in the local community
7or region of the district.
8(2) A baccalaureate degree pilot program shall notbegin delete duplicate begin insert
offer a baccalaureate degree already offered by
9similar programs offered by public postsecondary educational
10institutions, unless approved by the Chancellor of the California
11State University.end delete
12the California State University or the University of California.end insert
13(3) A district shall have the expertise, resources, and student
14interest to offer a quality baccalaureate degree in the chosen field
15of study.
16(4) A district shall not offer a baccalaureate degree at more
17than one campus within the district.
18(5) A district shall notify a student who applies to the district’s
19baccalaureate degree pilot program that the student is required
20to complete his or her baccalaureate degree by the end of the
212022-23 academic year, as specified in Section
78041.
22(d) A district shall maintain separate records for students who
23are enrolled in courses classified in the upper division and lower
24division of a baccalaureate program. A student shall be reported
25as a community college student for enrollment in a lower division
26course and as a baccalaureate degree program student for
27enrollment in an upper division course.
28(e) A governing board of a district seeking authorization to offer
29a baccalaureate degree pilot program shall submit all of the
30following for review by the Chancellor of the California
31Community Colleges and approval by the Board of Governors of
32the California Community Colleges:
33(1) Thebegin delete proposed governance systemend deletebegin insert
administrative planend insert for
34the baccalaureate degree pilot program.
35(2) The baccalaureate degree pilot program’s curriculum,
36faculty, and facilities.
37(3) Thebegin delete level of matriculation for students enrolled in aend delete
38begin insert enrollment projections for theend insert baccalaureate degreebegin insert
pilotend insert program.
39(f) (1) The Board of Governors of the California Community
40Colleges shall developbegin insert,end insert and adopt by regulationbegin insert,end insert a funding model
P6 1for the support of thebegin insert statewideend insert baccalaureate degree pilotbegin delete programsend delete
2begin insert programend insert that is based on a calculation of the number of full-time
3equivalent students enrolled in thebegin insert
districtend insert pilot programs.
4(2) Funding for each full-time equivalent student shall be at an
5agreed upon marginal cost calculation that shall not exceed the
6California State Universities marginal cost calculation.
7(3) Each student inbegin delete theend deletebegin insert aend insert baccalaureate degree pilotbegin delete programsend delete
8begin insert programend insert authorized by this article shall not be charged fees higher
9than the mandatory systemwide fees charged for baccalaureate
10degree programs at the California State University.
11(4) Fees for upper division coursework inbegin delete theend deletebegin insert aend insert baccalaureate
12degree pilotbegin delete programsend deletebegin insert programend insert shall be set and approved by the
13Legislature in a manner consistent with the setting of fees for lower
14division coursework at the California community colleges.begin insert Fees
15for lower division coursework in a baccalaureate degree pilot
16program shall not exceed the fees for other lower division
17coursework offered by the California Community Colleges.end insert
18(g) The governing board of
a district may enter into agreements
19with local businesses and agencies to provide educational services
20to students participating in a baccalaureate degree pilot program.
21(h) A district that received authorization to offer a baccalaureate
22degree pilot program shall submit a report to the Chancellor of the
23California Community Colleges at least one year prior to the
24expiration of the baccalaureate degree pilot program pursuant to
25Section
78041 or one year after the first graduating class of the
26baccalaureate degree pilot program, whichever occurs first. The
27report shall examine the success of the baccalaureate degree pilot
28program by evaluating all of the following factors:
29(1) The percentage of students who complete a baccalaureate
30degree, calculated by dividing the number of students who graduate
31from the baccalaureate degree pilot program by the number of
32students who enrolled in the program.
33(2) The extent to which the baccalaureate degree pilot program
34is self-supporting, such that the student fees charged pursuant to
35subdivision (f) cover the costs of the program.
36(3) Whether there is a problem with finding and paying
37instructors
for the baccalaureate degree pilot program.
38(4) Whether there was a decline in enrollment at California State
39University or University of California campuses in the regions
P7 1served by the district as a direct result of the baccalaureate degree
2pilot program.
3(5) The number of students who received jobs in the area in the
4field of study of their baccalaureate degree.
5(g) (1) The Department of Finance and the Legislative Analyst’s
6Office shall jointly conduct a statewide evaluation of the statewide
7baccalaureate degree pilot program implemented under this article.
8The
results of the evaluation shall be reported, in writing, to the
9Legislature and the Governor on or before July 1, 2021. The
10evaluation required by this section shall consider all of the
11following:
12(A) The number of new district baccalaureate degree pilot
13programs implemented, including information identifying the
14number of new programs, applicants, admissions, enrollments,
15and degree recipients.
16(B) The extent to which the baccalaureate degree pilot programs
17established under this article are fulfilling identified needs for new
18baccalaureate degree programs, including statewide supply and
19demand data that considers capacity at the California State
20University, the University of California, and in California’s
21independent colleges and universities.
22(C) Information on the place of employment of students and the
23
subsequent job placement of graduates.
24(D) Baccalaureate degree program costs and the funding
25sources that were used to finance these programs, including a
26calculation of cost per degree awarded.
27(E) The costs of the baccalaureate degree programs to students,
28the amount of financial aid offered, and student debt levels of
29graduates of the programs.
30(F) Time-to-degree rates and completion rates for the
31baccalaureate degree pilot programs.
32(G) The extent to which the programs established under this
33article are in compliance with the requirements of this article.
34(2) A district shall
submit the information necessary to conduct
35the evaluation require by paragraph (1), as determined by the
36evaluators, to the Chancellor of the California Community
37Colleges, who shall provide the information to the evaluators upon
38request.
P8 1(3) A report to be submitted pursuant to paragraph (1) shall be
2submitted in compliance with Section 9795 of the Government
3Code.
This article shall become inoperative on July 1, 2023,
5and as January 1, 2024, is repealed, unless a later enacted statute
6that is enacted before January 1, 2024 deletes or extends that date.
