SB 904, as introduced, Vidak. High-speed rail: private property: owner consent.
(1) Existing law creates the High-Speed Rail Authority with specified powers and duties relating to the development and implementation of an intercity high-speed train system. Existing law, for any project along the high-speed rail network, authorizes the authority to contract with the Department of Transportation to perform specified project design services, including construction inspection services.
This bill would require the authority to require any employee of the authority, or any employee working for a public or private entity that has contracted with the authority, prior to entering onto any privately-owned property, to identify himself or herself to the property owner and obtain the consent of the property owner, as specified.
(2) This bill would declare that it is to take effect immediately as an urgency statute.

The people of the State of California do enact as follows:
Section 185037.6 is added to the Public Utilities
2Code, to read:
Notwithstanding any other law, the authority shall
2require any employee of the authority, or any employee of a public
3or private entity that has contracted with the authority, to do both
4of the following before entering onto any privately owned property
5to perform a survey or inspection or for any other purpose:
6(a) Identify himself or herself to the property owner as an
7employee of the authority or a contractor of the authority working
8on the high-speed rail project.
9(b) Obtain the consent of the property owner to enter upon the
10property.
This act is an urgency statute necessary for the
12immediate preservation of the public peace, health, or safety within
13the meaning of Article IV of the Constitution and shall go into
14immediate effect. The facts constituting the necessity are:
15In order to make statutory changes necessary to permit the
16High-Speed Rail Authority to acquire real property to be used for
17the high-speed rail system, at the earliest possible time, it is
18necessary that this act take effect immediately.
