An act to amend Section 9004 of the Elections Code, relating to initiatives.

SB 931, as introduced, Anderson. Initiative measures: circulating title and summary.

Existing law requires, prior to the circulation of any initiative or referendum petition for signatures, that the text of the proposed measure be submitted to the Attorney General with a written request that a circulating title and summary of the chief purpose and points of the proposed measure be prepared. Existing law requires the Attorney General to prepare this title and summary upon receiving the text of the proposed measure and prescribes the manner in which the Attorney General is to prepare the document.

This bill would make technical, nonsubstantive changes to these provisions.

The people of the State of California do enact as follows:

SECTION 1.  

Section 9004 of the Elections Code is amended
2to read:

9004.  

(a) Upon receipt of the text of a proposed initiative
4measure, the Attorney General shall prepare a circulating title and
5summary of the chief purposes and points of the proposed measure.
6The circulating title and summary shall not exceed a total of 100
P2    1words. The Attorney General shall also provide a unique numeric
2identifier for each proposed initiative measure. The circulating
3title and summary shall be prepared in the manner provided for
4the preparation of ballot titles and summaries in Article 5
5(commencing with Section 9050), the provisions of which, in
6regard to the preparation, filing, and settlement of ballot titles and
7summaries, are hereby made applicable to the circulating title and
8summary.

9(b) The Attorney General shall provide a copy of the circulating
10 title and summary and its unique numeric identifier to the
11proponents and to the Secretary of State within 15 days after receipt
12of the fiscal estimate or opinion prepared by the Department of
13Finance and the Joint Legislative Budget Committee pursuant to
14Section 9005. The date the copy is delivered or mailed to the
15proponents is the “official summary date.”

16(c) Upon receipt of the circulating title and summary from the
17Attorney General, the Secretary of State shall, within one business
18day, notify the proponents and county elections official of each
19county of the official summary date and provide a copy of the
20circulating title and summary to each county elections official.
21This notification shall also include a complete schedulebegin delete showingend delete

23deadline by the counties to the Secretary of State.
