An act to amend Section 1122 of the Water Code, relating to water.

SB 938, as introduced, Galgiani. Water rights: reconsideration of a decision or order.

Existing law specifies procedures under which a person may be subject to administrative civil liability for unauthorized diversion or use of water. Existing law specifies procedures under which the State Water Resources Control Board is authorized to order a reconsideration of all or part of its decision or order.

This bill would make a technical, nonsubstantive change to these provisions.

The people of the State of California do enact as follows:

SECTION 1.  

Section 1122 of the Water Code is amended to
2read:

1122.  

The board may order a reconsideration of all or part of
4a decision or order on the board’s own motion or on the filing of
5a petition of any interested person or entity. The petition shall be
6filed not later than 30 days from the date the board adopts a
7decision or order. The authority of the board to order a
8reconsideration on its own motion shall expire 30 days after it has
9adopted a decision or order. The board shall order or deny

2the date the board adopts the decision or order.
