Existing law establishes the Measurement of Academic Performance and Progress (MAPP), and, commencing with the 2013-14 school year, requires the MAPP to be composed of (1) a consortium summative assessment in English language arts and mathematics for grades 3 to 8, inclusive, and grade 11, as specified, (2) science grade level assessments in grades 5, 8, and 10, measuring specified content standards, (3) the California Alternate Performance Assessment in grades 2 to 11, inclusive, in English language arts and mathematics and science in grades 5, 8, and 10, as specified, and (4) the Early Assessment Program. Existing law requires the Superintendent of Public Instruction, on or before March 1, 2016, to submit to the State Board of Education, the appropriate policy and fiscal committees of the Legislature, and the Director of Finance, recommendations on expanding the MAPP to include additional assessments, including assessments in history-social science, in accordance with specified requirements.

This bill would change the name of the MAPP to the California Assessment of Student Performance and Progress (CAASPP). The bill would require the CAASPP, commencing with the 2018-19 school year, to also be composed of a summative assessment in history-social science that is adopted by the state board, as specified. The bill would require the recommendations of the Superintendent submitted to the state board, the appropriate policy and fiscal committees of the Legislature, and the Director of Finance to include a plan to implement a summative assessment in history-social science commencing with the 2018-19 school year.

The County Employees Retirement Law of 1937 (CERL) authorizes counties to establish retirement systems pursuant to its provisions in order to provide pension benefits to county and district employees. 6(b) Commencing with the 2013-14 school year, thebegin delete MAPPend delete
7begin insert CAASPPend insert shall be composed of all of the following:

8(1) (A) A consortium summative assessment in English
9language arts and mathematics for grades 3 to 8, inclusive, and
10grade 11 that measures content standards adopted by the state
11board.

12(B) In the 2013-14 school year, the consortium summative
13assessment in English language arts and mathematics shall be a
14field test only, to enable the consortium to gauge the validity and
15reliability of these assessments and to conduct all necessary
16psychometric procedures and studies, including, but not necessarily
17limited to, achievement standard setting, and to allow the
P3    1department to conduct studies regarding full implementation of
2the assessment system. These field tests and results shall not be
3used for any other purpose, including the calculation of any
4accountability measure.

5(2) (A) Science grade level assessments in grades 5, 8, and 10
6that measure content standardsbegin insert adoptedend insert pursuant to Section 60605,
7until a successor assessment is implemented pursuant to
8subparagraph (B).

9(B) For science assessments, the Superintendent shall make a
10recommendation to the state board as soon as is feasible after the
11adoption of science content standards pursuant to Section 60605.85
12regarding the assessment of the newly adopted standards. Before
13making recommendations, the Superintendent shall consult with
14stakeholders, including, but not necessarily limited to, California
15science teachers, individuals with expertise in assessing English
16learners and pupils with disabilities, parents, and measurement
17experts, regarding the grade level and type of assessment. The
18recommendations shall include cost estimates and a plan for
19implementation of at least one assessment in each of the following
20grade spans:

21(i) Grades 3 to 5, inclusive.

22(ii) Grades 6 to 9, inclusive.

23(iii) Grades 10 to 12, inclusive.

24(3) The California Alternate Performance Assessment in grades
252 to 11, inclusive, in English language arts and mathematics and
26science in grades 5, 8, and 10, which measures content standards
27adopted pursuant to Section 60605 until a successor assessment
28is implemented. The successor assessment shall be limited to the
29grades and subject areas assessed pursuant to paragraph (1) and
30subparagraph (B) of paragraph (2).

31(4) The Early Assessment Program established by Chapter 6
32(commencing with Section 99300) of Part 65 of Division 14 of
33Title 3.

34(5) Commencing with the 2018-19 school year, a summative
35assessment in history-social science, as adopted by the state board
36in accordance with the recommendations made pursuant to
37paragraph (3) of subdivision (c).

39begin insert(6)end insert (A) The department shall make available to local educational
40agencies a primary language assessment aligned to the English
P4    1language arts standards adopted pursuant to Section 60605, as it
2read on January 1, 2013, for assessing pupils who are enrolled in
3a dual language immersion program that includes the primary
4language of the assessment and who are either nonlimited English
5proficient or redesignated fluent English proficient. The cost for
6thebegin insert primary languageend insert assessment shall be the same for all local
7educational agencies, and shall not exceed the marginal cost of
8the assessment, including any cost the department incurs to
9implement thisbegin delete section.end deletebegin insert paragraph.end insert

10(B) A local educational agency may administer a primary
11language assessment aligned to the English language arts standards
12adopted pursuant to Section 60605, as it read on January 1, 2013,
13at its own expense, and shall enter into an agreement for that
14purpose with the testing contractor. If the local educational agency
15chooses to administer a primary language assessment pursuant to
16this paragraph, the department shall reimburse the local educational
17agency for its costs, including a per pupil apportionment to
18administer the assessment pursuant to subdivision (l). The
19department shall determine the procedures for reimbursement.

20(C) The Superintendent shall consult with stakeholders,
21including assessment and English learner experts, to determine
22the content and purpose of a stand-alone language arts summative
23assessment in primary languages other than English that aligns
24with thebegin delete English-languageend deletebegin insert English languageend insert arts content standards.
25The Superintendent shall consider the appropriate purpose for this
26assessment, including, but not necessarily limited to, support for
27the State Seal of Biliteracy and accountability. It is the intent of
28the Legislature that an assessment developed pursuant to this
29section be included in the state accountability system.

30(D) The Superintendent shall report and make recommendations
31to the state board at a regularly scheduled public meeting no sooner
32than one year after the first full administration of the consortium
33computer-adaptive assessments in English language arts and
34mathematics summative assessments in grades 3 to 8, inclusive,
35and grade 11, regarding an implementation timeline and estimated
36costs of a stand-alone language arts summative assessment in
37primary languages other than English.

38(E) The Superintendent shall develop, and the state board shall
39adopt, a primary language assessment. The Superintendent shall
40administer this assessment no later than the 2016-17 school year.

P5    1(F) This paragraph shall be operative only to the extent that
2funding is provided in the annual Budget Act or another statute
3for the purpose of this section.

4(c) No later than March 1, 2016, the Superintendent shall submit
5to the state board recommendations on expanding thebegin delete MAPPend delete
6begin insert CAASPPend insert to include additional assessments, for consideration at a
7regularly scheduled public meeting. The Superintendent shall also
8submit these recommendations to the appropriate policy and fiscal
9committees of the Legislature and to the Director of Finance in
10accordance with all of the following:

11(1) In consultation with stakeholders, including, but not
12necessarily limited to, California teachers, individuals with
13expertise in assessing English learners and pupils with disabilities,
14parents, and measurement experts, the Superintendent shall make
15recommendations regarding assessments including the grade level,
16content, and type of assessment. These recommendations shall
17take into consideration the assessments already administered or
18planned pursuant to subdivision (b). The Superintendent shall
19consider the use of consortium-developed assessments, various
20item types, computer-based testing, and a timeline for
21implementation.

22(2) The recommendations shall consider assessments in subjects,
23including, but not necessarily limited to,begin delete history-social science,end delete
24 technology, visual and performing arts, and other subjects as
25appropriate, as well as English language arts, mathematics, and
26science assessments to augment the assessments required under
27subdivision (b), and the use of various assessment options,
28including, but not necessarily limited to, computer-based tests,
29locally scored performance tasks, and portfolios.

30(3) The recommendations shall also include a plan to implement
31a summative assessment in history-social science commencing
32with the 2018-19 school year.

6funding for this purpose, the Superintendent shall develop and

8test blueprints, achievement level descriptors, testing periods,
9performance standards, and a reporting plan for each approved
10assessment.

11(d) For the 2013-14 and 2014-15 school years, the department
12shall make available to local educational agencies Standardized
13Testing and Reporting Program test forms no longer required by
14thebegin delete MAPP.end deletebegin insert CAASPP.end insert The cost of implementing this subdivision,
15including, but not necessarily limited to, shipping, printing, scoring,
16and reporting per pupil shall be the same for all local educational
17agencies, and shall not exceed the marginal cost of the assessment,
18including any cost the department incurs to implement thisbegin delete section.end delete
19begin insert subdivision.end insert A local educational agency that chooses to administer
20an assessment pursuant to thisbegin delete sectionend deletebegin insert subdivisionend insert shall do so at
21its own expense, and shall enter into an agreement for that purpose
22with a contractor, subject to the approval of the department.

23(e) The Superintendent shall make available a paper and pencil
24version of any computer-basedbegin delete MAPPend deletebegin insert CAASPPend insert assessment for
25use by pupils who are unable to access the computer-based version
26of the assessment for a maximum of three years after a new
27operational test is first administered.

28(f) (1) From the funds available for that purpose, each local
29educational agency shall administer assessments to each of its
30pupils pursuant to subdivision (b). As allowable by federal statute,
31recently arrived English learner pupils are exempted from taking
32the assessment in English language arts. The state board shall
33establish a testing period to provide that all schools administer
34these tests to pupils at approximately the same time during the
35instructional year. The testing period established by the state board
36shall take into consideration the need of local educational agencies
37to provide makeup days for pupils who were absent during testing,
38as well as the need to schedule testing on electronic computing
39devices.

P7    1(2) For the 2013-14 school year, each local educational agency
2shall administer the field tests in a manner described by the
3department in consultation with the president or executive director
4of the state board. Additional participants in the field test beyond
5the representative sample may be approved by the department, and
6the department shall use existing contract savings to fundbegin delete districtend delete
7begin insert local educational agencyend insert participation in one or more tests per
8participant. Funds for this purpose shall bebegin delete utilizedend deletebegin insert usedend insert to allow
9for maximum participation in the fieldbegin delete testend deletebegin insert testsend insert across the state.
10To the extent savings in the current contract are not available to
11fully fund this participation, the department shall prorate available
12funds by test. Local educational agencies shall bear any additional
13costs to administer these assessments that are in excess of the
14contracted amount. With approval of the state board and the
15Director of Finance, the department shall amend the existing
16assessment contract to accommodate field testing beyond the
17representative sample, and to allow for special studies using
18information collected from the field tests.

19(g) From the funds available for that purpose, each local
20educational agency shall administer assessments as determined by
21the state board pursuant to paragraphbegin delete (5)end deletebegin insert (6)end insert of subdivision (c).

22(h) As feasible, thebegin delete MAPPend deletebegin insert CAASPPend insert field tests shall be
23conducted in a manner that will minimize the testing burden on
24individual schools. Thebegin delete MAPPend deletebegin insert CAASPPend insert field tests shall not
25produce individual pupil scores unless it is determined that these
26scores are valid and reliable.

27(i) The governing board of a school district may administer
28achievement tests in grades other than those required by this section
29as it deems appropriate.

30(j) The governing board of a school district may administer a
31primary language assessment aligned to the English language arts
32standards adopted pursuant to Section 60605 to a pupil identified
33as limited English proficient enrolled in any of grades 2 to 11,
34inclusive, who either receives instruction in his or her primary
35language or has been enrolled in a school in the United States for
36less than 12 months until a subsequent primary language
37assessment aligned to the common core standards in English
38language arts adopted pursuant to Section 60605.8 is developed
39pursuant to paragraphbegin delete (5)end deletebegin insert (6)end insert of subdivision (b). If the governing
40board of a school district chooses to administer this assessment,
P8    1it shall notify the department in a manner determined by the
2department.

3(k) Pursuant to Section 1412(a)(16) of Title 20 of the United
4States Code, individuals with exceptional needs, as defined in
5Section 56026, shall be included in the testing requirement of
6subdivision (b) with appropriate accommodations in administration,
7where necessary, andbegin delete thoseend deletebegin insert theend insert individuals with exceptional needs
8who are unable to participate in the testing, even with
9accommodations, shall be given an alternate assessment.

10(l) (1) The Superintendent shall apportion funds appropriated
11for these purposes to local educational agencies to enable them to
12meet the requirements of subdivisions (b) and (c).

13(A) For thebegin delete MAPPend deletebegin insert CAASPPend insert field tests administered in the
142013-14 school year or later school years, the Superintendent shall
15apportion funds to local educational agencies if funds are
16specifically provided for this purpose in the annual Budget Act.

17(B) The Superintendent shall apportion funds to local
18educational agencies to enable them to administer assessments
19used to satisfy the voluntary Early Assessment Program in the
202013-14 school year pursuant to paragraph (4) of subdivision (b).

21(2) The state board annually shall establish the amount of
22funding to be apportioned to local educational agencies for each
23test administered and annually shall establish the amount that each
24contractor shall be paid for each test administered under the
25contracts required pursuant to Section 60643. The amounts to be
26paid to the contractors shall be determined by considering the cost
27estimates submitted by each contractor each September and the
28amount included in the annual Budget Act, and by making
29allowance for the estimated costs tobegin delete school districtsend deletebegin insert local
30educational agenciesend insert
for compliance with the requirements of
31subdivisions (b) and (c). The state board shall take into account
32changes to local educational agency test administration activities
33under thebegin delete MAPP,end deletebegin insert CAASPP,end insert including, but not limited to, the
34begin delete number,end deletebegin insert number andend insert type of testsbegin delete administered,end deletebegin insert administeredend insert and
35changes in computerized test registration and administration
36procedures, when establishing the amount of funding to be
37apportioned to local educational agencies for each test
38administered.

39(3) An adjustment to the amount of funding to be apportioned
40per test shall not be valid without the approval of the Director of
P9    1Finance. A request for approval of an adjustment to the amount
2of funding to be apportioned per test shall be submitted in writing
3to the Director of Finance and the chairpersons of the fiscal
4committees of both houses of the Legislature with accompanying
5material justifying the proposed adjustment. The Director of
6Finance is authorized to approve only those adjustments related
7to activities required by statute. The Director of Finance shall
8 approve or disapprove the amount within 30 days of receipt of the
9request and shall notify the chairpersons of the fiscal committees
10of both houses of the Legislature of the decision.

11(m) For purposes of making the computations required by
12Section 8 of Article XVI of the California Constitution, the
13appropriation for the apportionments made pursuant to paragraph
14(1) of subdivision (l), and the payments made to the contractors
15under the contracts required pursuant to Section 60643 or
16subparagraph (C) of paragraph (1) of subdivision (a) of Section
1760605 between the department and the contractor, are “General
18Fund revenues appropriated for school districts,” as defined in
19subdivision (c) of Section 41202, for the applicable fiscal year,
20and included within the “total allocations to school districts and
21community college districts from General Fund proceeds of taxes
22appropriated pursuant to Article XIII  B,” as defined in subdivision
23(e) of Section 41202, for that fiscal year.

24(n) As a condition to receiving an apportionment pursuant to
25subdivision (l), a local educational agency shall report to the
26Superintendent all of the following:

27(1) The pupils enrolled in the local educational agency in the
28grades in which assessments were administered pursuant to
29subdivisions (b) and (c).

30(2) The pupils to whom an achievement test was administered
31pursuant to subdivisions (b) and (c) in the local educational agency.

32(3) The pupils in paragraph (1) who were exempted from the
33test pursuant to this section.

34(o) The Superintendent and the state board are authorized and
35encouraged to assist postsecondary educational institutions to use
36the assessment results of thebegin delete MAPP,end deletebegin insert CAASPP,end insert including, but not
37necessarily limited to, the grade 11 consortium summative
38assessments in English language arts and mathematics, for
39academic credit, placement, or admissions processes.

P10   1(p) Subject to the availability of funds in the annual Budget Act
2for this purpose, and exclusive of the consortium assessments, the
3Superintendent, with the approval of the state board, annually shall
4release to the public test items from the achievement tests pursuant
5to Section 60642.5 administered in previous years. Where feasible
6and practicable, the minimum number of test items released per
7year shall be equal to 25 percent of the total number of test items
8on the test administered in the previous year.

9(q) On or before July 1, 2014, Sections 850 to 868, inclusive,
10of Title 5 of the California Code of Regulations shall be revised
11by the state board to conform to the changes made to this section
12in the first year of the 2013-14 Regular Session. The state board
13shall adopt initial regulations as emergency regulations to
14immediately implement thebegin delete MAPPend deletebegin insert CAASPPend insert assessments,
15including, but not necessarily limited to, the administration,
16scoring, and reporting of the tests, as the adoption of emergency
17regulations is necessary for the immediate preservation of the
18public peace, health, safety, or general welfare within the meaning
19of Section 11346.1 of the Government Code. The emergency
20regulations shall be followed by the adoption of permanent
21regulations, in accordance with the Administrative Procedure Act
22(Chapter 3.5 (commencing with Section 11340) of Part 1 of
23Division 3 of Title 2 of the Government Code).

SECTION 1.  

Section 31452 of the Government Code is

The right of a person to a pension, annuity, retirement
27allowance, return of contributions, the pension, annuity, or
28retirement allowance, an optional benefit, any other right accrued
29or accruing to a person under this chapter, the money in the fund
30created or continued under this chapter or the California Public
31Employees’ Pension Reform Act of 2013, and property purchased
32for investment purposes pursuant to this chapter, are exempt from
33taxation, including inheritance tax, whether state, county,
34municipal, or district. They are not subject to execution or other
35court process except to the extent permitted by Section 31603 of
36this code and Section 704.110 of the Code of Civil Procedure, and
37are unassignable except as specifically provided in this chapter.
