Under the Community Facilities Law of 1911, the governing body of a consolidated sanitation district located in Orangebegin delete County, whichend deletebegin insert County thatend insert has been formed under specified circumstances,begin delete is composed ofend deletebegin insert now known as the Orange County Sanitation District, includes, among other persons,end insert one member of the city council of each city located wholly or partially within the district’s boundaries,begin delete as specified, one member of the county board of supervisors, one member of the governing body of each sanitary district, as specified, and one member of the governing body of a public agency empowered to and engaged in the collection, transportation, treatment, or disposal of sewage,end delete
as specified.
This bill would revise the governing body ofbegin delete a consolidated sanitation district located inend deletebegin insert
theend insert Orange Countybegin insert Sanitation Districtend insert to instead include one member of the city council of each city, except the City of Yorba Linda, as specified,begin delete one member of the county board of supervisors, one member of the governing body of each sanitary district, as specified, one member of the governing body of a public agency empowered to and engaged in the collection, transportation, treatment, or disposal of sewage, as specified,end delete and one member of the governing body of the Yorba Linda Water District.
This bill would make legislative findings and declarations as to the necessity of a special statute for thebegin delete consolidated sanitation district inend delete Orange
Countybegin insert Sanitation Districtend insert, the City of Yorba Linda, and the Yorba Linda Water District.

The people of the State of California do enact as follows:
Section 4730.65 of the Health and Safety Code
2 is amended to read:
(a) Notwithstanding Sections 4730,begin delete 4730.1end deletebegin insert 4730.1,end insert
4 and 4730.2, or any otherbegin delete provision of law, a sanitation district in
5Orange County, that has been created by the consolidation,
6pursuant to the Cortese-Knox-Hertzberg Local Government
7Reorganization Act of 2000 (Division 3 (commencing with Section
856000) of Title 5 of the Government Code), of one or more
9sanitation districts, originally established pursuant to Section 4730,
10and one or more sanitation districts, originally established pursuant
11to Section 4730.1, shall be referred to, for purposes of this section
12only, as a consolidated sanitation district and the governing body
13shall be constituted in accordance with subdivision (b).end delete

22is necessary and that a general law cannot be made applicable

24Constitution because of the special circumstances surrounding the
25change in composition of the governing body of thebegin delete consolidated Orange Countybegin insert Sanitation Districtend insert resulting
26sanitation district inend delete
27from the transfer of sanitation duties from the City of Yorba Linda
28to the Yorba Linda Water District.
