           SUMMARY

This bill repeals or modifies numerous provisions of the
Education Code that are considered obsolete or unnecessary
in light of the passage of the Local Control Funding
Formula / Local Control Accountability Plans (Chapters 47
          and 357, Statutes of 2013).

           BACKGROUND

Current law, the Local Control Funding Formula (LCFF),
enacted as part of the 2013-14 State Budget is a
significant reform to the state's system of financing
K-12 public schools. The LCFF replaces the prior system of
revenue limits and restricted funding for a multitude of
categorical programs with a new funding formula that
provides base funding for the core educational needs of all
students and supplemental funding for the additional
educational needs of low-income students, English learners,
and foster youth. Because the LCFF funds have limited
spending restrictions, local education agencies have
considerable flexibility to direct LCFF resources to best
          meet their students' needs.

Although local education agencies have considerably more
flexibility in how they spend their resources under LCFF
compared to the previous funding system, the law requires a
school district, county office of education, or charter
          school:

"...to increase or improve services for
          unduplicated pupils [low-
income students, English learners, and foster

                                                                SB 971
                                                                Page 2

          youth] in proportion to
the increase in funds apportioned on the basis of
          the number and
concentration of unduplicated pupils in the
          school district, county
office of education, or charter school."

Under the old system, revenue limits provided LEAs with
discretionary (unrestricted) funding for general education
purposes, and categorical program (restricted) funding was
provided for specialized purposes, with each program having
unique allocation and spending requirements. Revenue
limits made up about two-thirds of state funding for
schools, while categorical program funding made up the
remaining one-third portion. For some time, that system was
criticized as being too state-driven, bureaucratic,
complex, inequitable, and based on outdated allocation
methods that did not reflect current student needs.
To ensure accountability for LCFF funds, the state also
mandated that each local education agency develop a local
control and accountability plan (LCAP) that identifies
locally determined goals, actions, services, and
expenditures of LCFF funds for each school year in support
of the state educational priorities that are specified in
statute, as well as any additional local priorities.

The eight state priorities that must be addressed in the
LCAP, for all students and significant student subgroups in
a school district and at each school, are: (1) Williams
settlement issues (adequacy of credentialed teachers,
instructional materials, and school facilities); (2)
implementation of academic content standards; (3) parental
involvement; (4) pupil achievement (in part measured by
statewide assessments and the API); (5) pupil engagement
          (as measured by attendance, graduation and dropout data;
          (6) school climate (in part measured by suspension and
expulsion rates); (7) the extent to which students have
access to a broad course of study; and (8) pupil outcomes
for non-state assessed courses of study. The board is
charged with adopting a template, by March 31, 2014, that
will guide local education agencies' development of their
          LCAPs.

School district LCAPs are subject to review and approval by
county offices of education. Statute established a process
for districts to receive technical assistance related to

           STAFF COMMENTS

           1) According to the author . This bill simply removes
Education Code Sections that remain on the books
despite being rendered obsolete by the enactment of
               the Local Control Funding.

           2) SB 587 (Emmerson, 2013) was the genesis of SB 971. SB
587 was amended at the end of last year's session to
incorporate changes to the Education Code in light of
the passage of LCFF. According to Senator Emmerson at

                                                                SB 971
                                                                Page 11

the time, SB 587 was to begin the discussion amongst
all parties, to achieve consensus, about sections of
the Education Code that could possibly be repealed or
modified. The elements of SB 587 were originally
drafted by the Department of Finance (DOF), and were a
               first attempt to "clean up" the Education Code;
however, these provisions were viewed through the
prism of DOFs perspective on implementation of LCFF
(generally from DOF perspective almost everything was
discretionary), and not on the merits of each statute
and the intent behind them. In late fall 2013; the
Department of Finance, California Department of
Education, and Senate legislative staff met multiple
times to discuss elements that could be part of SB
               587.

As previously mentioned, multiple meetings took place
to determine, through a consensus approach, what code
sections could be repealed or changed in light of
LCFF. Most, but not all, of the Sections in SB 971
were discussed, section-by-section, in order to
ascertain (1) whether the actions proposed were
consistent with LCFF, (2) the bill does not impede
pending legislation or legislative discussions, (3)
the bill did not impact past or pending judicial
actions, and (4) determine whether any of the proposed
changes could lead to any unintended consequences at
either a programmatic, budget or auditing level.

           3) SB 971 (Cannella), likely the first of many pieces of
legislation . The process of determining what sections
of the Education Code should remain in light of LCFF
will likely take many pieces of legislation over a
significant period of time. However daunting the
task, SB 971 is a solid first step in this arena.
Nevertheless, at this time, there are many proposals
embedded in SB 971 that need to be removed for further
               discussion.

Building on the discussions of fall 2013, and various
other points of contact, staff recommends the
following be removed from the bill:
                Sections : 8, 11, 18, 21, 23, 24, 27, 28, 36-44, 47,
               50, 52, 55, 58, 59, 60, 64-66, 68, 69, 76, 80, 82, 88,
               92, 94, 96-99, 104-112.
