An act to amend Section 44277 of the Education Code, relating to school employees.

Existing law requires the Commission on Teacher Credentialing to establish standards and procedures for the issuance and renewal of teaching credentials. Existing law expresses the Legislature’s intent to encourage teachers to engage in an individual program of professional growth that extends a teacher’s content knowledge and teaching skills. Existing law provides that an individualized program of professional growth may consist of specified activities and courses.

SECTION 1.  

Section 44277 of the Education Code is amended
2to read:

44277.  

(a) The Legislature recognizes that effective
4professional growth must continue to occur throughout the careers
5of all teachers, in order that teachers remain informed of changes
6in pedagogy, subject matter, and pupil needs. In enacting this
7section, it is the intent of the Legislature to encourage teachers to
8engage in an individual program of professional growth that
9extends their content knowledge and teaching skills and for school
10districts to establish professional growth programs that give
11individual teachers a wide range of options to pursue as well as
12significant roles in determining the course of their professional
13growth.

14(b) An individual program of professional growth may consist
15of activities that are aligned with the California Standards for the
16Teaching Profession that contribute to competence, performance,
17or effectiveness in the profession of education and the classroom
18assignments of the teacher. Acceptable activities may include,
19among other acceptable activities, the completion of courses offered
20by regionally accredited colleges and universities, including
21instructor-led interactive courses delivered through online
22technologies; participation in professional conferences, workshops,
23teacher center programs, staff development programs, or a
24California Reading Professional Development Program operated
25pursuant to Article 2 (commencing with Section 99220) of Chapter
265 of Part 65; service as a mentor teacher; participation in school
27curriculum development projects; participation in systematic
28programs of observation and analysis of teaching; service in a
29leadership role in a professional organization; and participation in
30educational research or innovation efforts. Employing agencies
31and the bargaining agents of employees may negotiate to agree on
32the terms of programs of professional growth within their
P3    1jurisdictions, provided that the agreements shall be consistent with
2this section.

3(c) An individual program of professional growth may include
4a basic course in cardiopulmonary resuscitation, which includes
5training in the subdiaphragmatic abdominal thrust (also known as
6the “Heimlich maneuver”) and meets or exceeds the standards
7established by the American Heart Association or the American
8Red Cross for courses in that subject or minimum standards for
9training programs established by the Emergency Medical Services
10Authority. An individual program of professional growth may also
11include a course in first aid that meets or exceeds the standards
12established by the American Red Cross for courses in that subject
13or minimum standards for training programs established by the
14Emergency Medical Services Authority.

15(d) (1) If a local educational agency offers a program of
16professional growth for teachers, administrators, paraprofessional
17educators, or other classified employees involved in the direct
18instruction of pupils, the local educational agency shallbegin delete consider

20all of the following criteria, and the local educational agency is
21encouraged to choose professional learningend insert

22the following criteria:

23(A) Helps attract, grow, and retain effective educators.

24(B) Is a part of every educator’s experience in order to accelerate
25instructional improvement and support pupil learning.

26(C) Is based on needs assessment of educators and tied to
27supporting pupil learning.

28(D) Emphasizes the importance of meeting the needs of all
29pupils.

30(E) Is grounded in a description of effective practice, as
31articulated in the California Standards for the Teaching Profession.

32(F) Affords educators opportunities to engage with others to
33develop their craft, including, but not limited to, opportunities to
34increase their content knowledge.

35(G) Ensures educators have adequate time to learn about,
36practice, reflect, adjust, critique, and share what educators need
37to ensure that all pupils, especially high-needs pupils, develop
38knowledge and lifelong learning skills that will help the pupils to
39be successful.

40(H) Recognizes and utilizes expert teacher and leader skills.

P4    1(I) Attends to collective growth needs as well as educators’
2individual growth needs.

3(J) Contributes to a positive, collaborative, and supportive adult
4learning environment.

5(K) Contributes to cycles of inquiry and improvement.

6(L) Is not limited to a single instance, but supports educators
7through multiple iterations or engagements.

8(M) Is based on a coherent and focused plan.

9(2) Professionalbegin delete developmentend deletebegin insert learningend insert activities may also
10include collaboration time for teachers to develop new instructional
11lessons, to select or develop common formative assessments, to
12analyze pupil data, for mentoring projects for new teachers, or for
13extra support for teachers to improve practice. Appropriate
14professionalbegin delete developmentend deletebegin insert learningend insert may be part of a coherent plan
15that combines school activities within the school, including, but
16not limited to, lesson study or coteaching, and external learning
17opportunities that meet all of the following criteria:

18(A) Are related to the academic subjects taught.

19(B) Provide time to meet and work with other teachers.

20(C) Support instruction and pupil learning to improve instruction
21in a manner that is consistent with academic content standards.

22(e) For purposes of this section, “local educational agency”
23means a school district, county office of education, or charter
24school.
