An act to amend Section 3010 of the Elections Code, relating to elections.

Existing law sets forth the procedures by which a voter may apply for and receive a vote by mail ballot. Existing law requires an elections official to deliver to each qualified applicant the vote by mail ballot for the precinct in which the applicant resides and all supplies necessary for the use and return of the ballot.

This bill would require the elections official to also deliver to each qualified applicant a return envelope with postage prepaidbegin insert by the Secretary of Stateend insert in which a vote by mail voter may return his or her ballot if the ballot is to be mailed within the territorial limits of the United States or the District of Columbia.begin delete By imposing additional duties on local elections officials, this bill would impose a state-mandated local program.end delete

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

SECTION 1.  

Section 3010 of the Elections Code is amended
2to read:

3010.  

(a) The elections official shall deliver the following to
4each qualified applicant:

5(1) The ballot for the precinct in which he or she resides. In
6primary elections, this shall also be accompanied by the ballot for
7the central committee of the party with which the voter is affiliated,
8if any.

9(2) All supplies necessary for the use and return of the ballot,

if the ballot is to be mailed within the territorial
12limits of the United States or the District of Columbia.

13(3) All payments for postage made pursuant to subdivision (a)(2)
14shall be made directly from funds appropriated to the Secretary
15of State for this purpose.

16(b) An officer of this state shall not make any charge for services
17rendered to any voter under this chapter.

SEC. 2.  

If the Commission on State Mandates determines that
19this act contains costs mandated by the state, reimbursement to
20local agencies and school districts for those costs shall be made
21pursuant to Part 7 (commencing with Section 17500) of Division
224 of Title 2 of the Government Code.
