An act to add Section 33319.7 to the Education Code, relating to state educational agencies.

Existing law requires the Superintendent of Public Instruction, with the approval of the State Board of Education, to develop an Academic Performance Index (API) to measure the performance of schools and school districts, especially the academic performance of pupils. Existing federal law, the No Child Left Behind Act of 2001, contains provisions generally requiring states to adopt performance goals for their public elementary and secondary schools, and to demonstrate that these public schools are making adequate yearly progress, as measured by pupil performance on standardized tests as well as other measures, to satisfy those goals. Existing law requires the State Department of Education to report test results of all state-mandated testing programs to the individual school districts by a specified date. Existing law requires the department to compile an attrition rate for high school pupils in the state. Existing law, the Open Enrollment Act, authorizes the parent of a pupil enrolled in a low-achieving school, as defined, to submit an application for the pupil to attend a school in a school district of enrollment, as defined, as specified.

This bill would require the department to create a parent resources Internet Web site that provides specific information relating to public school options, includingbegin insert, among other things,end insert information regarding the Open Enrollmentbegin delete Act,end deletebegin insert Actend insert and school district and school level reports on pupil outcomes, including the API. The bill would also require the department to provide a link to the parent resources Internet Web site on its main Internet Web site. The bill would require the Superintendent,begin delete prior toend deletebegin insert beforeend insert implementing this act, to make a determination whether the implementation of thisbegin delete section,end deletebegin insert act,end insert at a minimum, is consistent withbegin insert theend insert Internet Web site policy of the department and state and federal requirements for the security and privacy of pupil data and department data.

The people of the State of California do enact as follows:

SECTION 1.  

Section 33319.7 is added to the Education Code,
2to read:

33319.7.  

(a) The department shall create a parent resources
4Internet Web site that provides all of the following information:

5(1) Public school options for pupils that includes, but is not
6limited to, information relating to the following:

7(A) The Open Enrollment Act pursuant to Article 10
8(commencing with Section 48350) of Chapter 2 of Part 27 of
9Division 4 of Title 2.

10(B) School districts of choice, as that term is defined in Section
1148300.

12(C) Parent empowerment options, pursuant to Article 3
13(commencing with Section 53300) of Chapter 18 of Part 28 of
14 Division 4 of Title 2.

15(D) Schools identified by the state board pursuant to the federal
16Unsafe School Choice Option under Section 9532 of the federal
17No Child Left Behind Act of 2001 (20 U.S.C. Sec. 6301 et seq.).

18(E) Charter schools.

19(F) Local control and accountability plans, including parental
20involvement in the development, participation, and review of local
21control and accountability plans, pursuant to Article 4.5
P3    1(commencing with Section 52060) of Chapter 6.1 of Part 28 of
2Division 4.

3(2) (A) School district and school level reports on pupil
4outcomes that include, but are not limited to, all of the following:

5(i) Standardized test scores, including, but not limited to, scores
6from the Academic Performance Index, Adequate Yearly Progress,
7Standardized Testing and Reporting, and Measurement of
8Academic Performance and Progress.

9(ii) Graduation rates.

10(iii) School accountability report cards.

11(B) The information required to be included pursuant to this
12paragraph shall be included only to the extent that information is
13not available in a local control and accountability plan, pursuant
14to Article 4.5 (commencing with Section 52060) of Chapter 6.1
15of Part 28 of Division 4.

16(3) Information relating to eligibility for specific public school
17 options based on school of residence and school district of
18residence.

19(4) The state policy for interdistrict and intradistrict transfers
20and how parents can apply for these transfers.

21(5) Information on career education programs, including, but
22not limited to, partnership academies, regional occupational
23centers and programs, agricultural education programs, and linked
24learning opportunities.

25(6) Elementary and secondary schools honored by the United
26States Department of Education as a National Blue Ribbon School
27or honored by the department as a California Distinguished School.

28(b) The information required to go on the Internet Web site
29pursuant to subdivision (a) shall include relevant information to
30individual schools that can be searched using an interactive
31database.

32(c) The department shall provide a link to the parent resources
33Internet Web site on the department’s main Internet Web site.

34(d) The department is encouraged to provide the information
35required pursuant to this section in both English and Spanish.
