An act to amend Section 219 of the Code of Civil Procedure, relating to jurors.

LEGISLATIVE COUNSEL’S DIGEST

SB 1133, as introduced, Anderson. Juries: peace officer exemption.

Existing law exempts certain peace officers from voir dire in civil and criminal matters, and other specified peace officers from voir dire in criminal matters.

This bill would exempt designated employees of the Department of Fish and Game, as specified, from voir dire in both civil and criminal matters.

Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no.

The people of the State of California do enact as follows:

SECTION 1.  

Section 219 of the Code of Civil Procedure is
2amended to read:

219.  

(a) Except as provided in subdivision (b), the jury
4commissioner shall randomly select jurors for jury panels to be
5sent to courtrooms for voir dire.

6(b) (1) Notwithstanding subdivision (a), no peace officer, as
7defined in Section 830.1,begin delete subdivisionend deletebegin insert subdivisionsend insert (a)begin insert and (e)end insert of
8Section 830.2, and subdivision (a) of Section 830.33, of the Penal
9Code, shall be selected for voir dire in civil or criminal matters.

P2    1(2) Notwithstanding subdivision (a), no peace officer, as defined
2in subdivisions (b) and (c) of Section 830.2 of the Penal Code,
3shall be selected for voir dire in criminal matters.
